Justice A.K.BASHEER\n\n Dated :31\/05\/2007\n\n O R D E R\n                              A.K.BASHEER, J.\n\n                       -------------------------------------------\n\n                         W.P.(C)No.12190 OF 2007\n\n                       -------------------------------------------\n\n                   Dated this the 31st day of May, 2007\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      Petitioners   are   stated   to   be   working   as   Higher   Secondary<\/p>\n<p>School   Teachers   (Junior)   (Arabic)   in   Government   schools   at<\/p>\n<p>Palakkad   and   Trivandrum   respectively.     As   per   order   dated<\/p>\n<p>March   23,   2007,   a   copy   of   which   is   on   record   as   Ext.P6,   the<\/p>\n<p>Director   of   Higher   Secondary   Education   held   that   petitioners<\/p>\n<p>were   liable   to   be   reverted   as   High   School   Assistants   to   their<\/p>\n<p>parent   department   with   immediate   effect.     The   above   view   was<\/p>\n<p>taken   on   the   basis   of   Ext.P5   order   passed   by   the   Director   by<\/p>\n<p>which   seniority   of   the   petitioners   was   reassigned.     By   such<\/p>\n<p>reassignment,   it   become   necessary   that   petitioners   had   to   be<\/p>\n<p>reverted.\n<\/p>\n<\/p>\n<p>      2.    It  is the  contention  of the  petitioners  that  no reversion<\/p>\n<p>will be necessary since there are sufficient posts to accommodate<\/p>\n<p>the petitioners as Higher Secondary teachers (Junior) at present.<\/p>\n<p>Petitioners   have   pointed   out   certain   vacancies   in   the   writ<\/p>\n<p>petition.  It is their contention that   going by their seniority they<\/p>\n<p>can be accommodated.  This is a matter to be looked into by the<\/p>\n<p>department.\n<\/p>\n<p>\nW.P.(C)No.12190 OF 2007<\/p>\n<p>                                      ::  2  ::\n<\/p>\n<\/p>\n<p>       3.     Therefore,   the   writ   petition   is   disposed   of   with   a<\/p>\n<p>direction   to   respondent   no.2  to   consider  the   request  if  any  that<\/p>\n<p>may be  made  by  them  in  writing  within  seven  days  from   today.<\/p>\n<p>Appropriate   orders   on   the   said   request   shall   be   passed   by<\/p>\n<p>respondent no.2 strictly on its merit and in accordance with law<\/p>\n<p>as expeditiously as possible, at any rate, within one month from<\/p>\n<p>the   date   of   receipt   thereof.     It   must   be   ensured   by   respondent<\/p>\n<p>no.2   that   apart  from   petitioners,   all  others   who   are   likely   to   be<\/p>\n<p>affected   by   the   order   that   may   be   passed   by   him,   are   afforded<\/p>\n<p>sufficient   opportunity   to   be   heard   before   any   such   decision   is<\/p>\n<p>taken.  Petitioners shall produce a copy of the writ  petition along<\/p>\n<p>with a certified copy of the judgment before respondent no.2 for<\/p>\n<p>compliance.
