Justice V.GIRI\n\n Dated :09\/07\/2009\n\n O R D E R\n                       V.GIRI, J.\n         ----------------------------------------\n               W.P.(C).No.18815 of 2009\n         ----------------------------------------\n          Dated this the 9th day of July, 2009.\n\n\n                      JUDGMENT\n<\/pre>\n<p>        The petitioner&#8217;s father belongs to Kudumbi<\/p>\n<p>community, which is treated as an OBC and her<\/p>\n<p>mother belongs to Kurava community, which is a<\/p>\n<p>scheduled    caste.    The    petitioner    applied for<\/p>\n<p>admission to the professional course, 2009 and in<\/p>\n<p>her application to the Entrance Commissioner, she<\/p>\n<p>sought reservation as a member of the Scheduled<\/p>\n<p>caste-Kuruva Community. The issue was referred to<\/p>\n<p>the KIRTADS and the anthropological studies<\/p>\n<p>conducted, as evidenced by Ext.P1, shows that the<\/p>\n<p>petitioner had been brought up in the milieu and the<\/p>\n<p>status of her father. Essentially, therefore, the<\/p>\n<p>recommendation is that she must be treated as<\/p>\n<p>Hindu Kudumbi, which is an OBC. The petitioner is<\/p>\n<p>aggrieved that she is considered as a Scheduled<\/p>\n<p>Caste and hence the writ petition praying for<\/p>\n<p>appropriate reliefs.\n<\/p>\n<p>W.P.(C).No.18815 of 2009<\/p>\n<p>                           :: 2 ::\n<\/p>\n<\/p>\n<p>          2.   Learned Special Government Pleader<\/p>\n<p>submits that the petitioner is brought up in the<\/p>\n<p>circumstances of her father, and even Ext.P2, which<\/p>\n<p>according to the learned Government Pleader, is<\/p>\n<p>only a recommendation and the petitioner continued<\/p>\n<p>to assert the status of a Scheduled Caste before the<\/p>\n<p>screening committee as well. It is, therefore, that a<\/p>\n<p>reference has been made to the School records, in<\/p>\n<p>which the petitioner&#8217;s community is shown as<\/p>\n<p>Kurava-Scheduled caste. Hence the petitioner was<\/p>\n<p>decided to be treated as a Scheduled Caste.<\/p>\n<p>          3.    It is true that the petitioner had<\/p>\n<p>originally claimed the status of a Scheduled Caste.<\/p>\n<p>There is no dispute that her mother belongs to<\/p>\n<p>Kurava Community, which is a Scheduled Caste.<\/p>\n<p>There is also no dispute that her father belongs to<\/p>\n<p>Kudumbi community, which is treated as an OBC.<\/p>\n<p>Generally, the offspring must be assigned the caste<\/p>\n<p>of its father, if the parents belong to different castes.<\/p>\n<p>W.P.(C).No.18815 of 2009<\/p>\n<p>                            :: 3 ::\n<\/p>\n<p>In the present case, Ext.P2 shows that the<\/p>\n<p>petitioner&#8217;s claim was gone into by the competent<\/p>\n<p>authority and it was found that the petitioner was<\/p>\n<p>brought up in the milieu and status of her father&#8217;s<\/p>\n<p>community.      There are no materials to take a<\/p>\n<p>different view.
