  ‘impugned judgment and award dated 03\/ 03 \/ 2006 passed in<\/p>\n
 MVC No. 7715\/2004 b he X Additional SCJ and Member,<\/p>\n

Motor Accidents Claims Tribunal, Bangalore {SCCH–16),<\/p>\n
(hereinafter referred as ‘ Tribunal’ for short}.<\/p>\n
2. The Tribunal by its judgment and <\/p>\n
awarded a sum of 34,21,000\/– under differentlieads H<\/p>\n
interest at 6% per annum from the’ d’a\u00b0’te of till -fits;<\/p>\n
payment. as against the claim of  a <\/p>\n
?8,00,000\/-. on account of the.__?d’eathA.of.__the_ldece=ase’d s:Sri. ” V<\/p>\n
Shivanna , in the road traffic accident. V’<\/p>\n
3. In brief, the factsoi     .\n<\/p>\n
The c1ai.man’t__  claimant Nos. 2 and 3<\/span>

\nhave \ufb01leda ciairn’epetitioitifoiefolre the Tribunal under section<\/p>\n
166 of   claimingddlcompensation of ?8,00,000\/–, on<\/p>\n
‘lacc\u00a25ut1tte’2’\u00a2f the death” of the deceased in the road traffic<\/p>\n
 ca.cciidVent.ljcontenlding that, on 22.8.2004 at about 3.30<\/p>\n
  deceased was going on the left side of the road<\/p>\n
   wl’ie.nA:’he came infront of Aralikatte road on NH4, at that<\/p>\n
it   driver of the autorickshaw bearing No.KA–6-A–1997<\/p>\n
  it Hdrlove the same in a rash and negligent manner and dashed<\/p>\n
 against the deceased, 0 which he sustained grievous<\/p>\n
Tribunal is liable to be modified on the ground that the<\/p>\n
vehicle in question was not involved in the accident.<\/p>\n
therefore, the liability fastened on the  _<\/p>\n
contrary to the docurnentary evidence av’ailablelVon’filer_l ”<\/p>\n
and also that the quantum of com;D’en’sati.o’n._la\\.vardeti:_’<\/p>\n
by the Tribunal is on higher”?VS-ide and ~ thereforegit\u00ab.r1e–eds <\/p>\n

6. As   le’alriied._.___\u00a3counsel for the
\nclaimants,   substantiated the
\n by the Tribunal.\n<\/p>\n

 awarded’nlthercornpensation under different heads and<\/p>\n
  and reasonable and therefore, it does<\/p>\n

available on file at threadbare, including the impugned<\/p>\n
 judgrnent and award passed by the Tribunal, we do not<\/p>\n
find any error of law, less material irregularity as<\/p>\n
such committed by the Tribunal in allowing the claim<\/p>\n
petition filed by the claimants by awarding reasonable<\/p>\n
compensation fastening the liability on the Insi1..I’_efr;V’:’  V.<\/p>\n
