Justice J.M.JAMES\n\n Dated :26\/10\/2006\n\n O R D E R\n                          J.M.JAMES, J.\n\n                          -------------------\n\n                         B.A. 6324\/2006\n\n                         --------------------\n\n  DATED THIS THE 26TH DAY OF OCTOBER, 2006\n\n\n\n\n                            O R D E R\n<\/pre>\n<p>            The petitioners 1 to 3 are accused Nos. 1, 5 and<\/p>\n<p>6 in crime No.570\/2006 of Manjeri Police Station,   for the<\/p>\n<p>offence   punishable   under   Section   420   IPC   read   with<\/p>\n<p>Section 34 IPC.\n<\/p>\n<\/p>\n<p>      2.    The learned Public Prosecutor submits that the<\/p>\n<p>first   accused   had   introduced   the   second   accused   to   the<\/p>\n<p>defacto   complainant,   as   a   person     possessing   gold   bars.<\/p>\n<p>Accordingly,   the complainant   purchased   5  Kgs. of gold<\/p>\n<p>bars   from the second accused.   Later on   it was found to<\/p>\n<p>be   spurious   gold.       The   first   and   second   accused   were<\/p>\n<p>arrested   in   connection   with   another   case   of   Mannarkad<\/p>\n<p>police   station.     During   the   interrogation,   they   had<\/p>\n<p>confessed   the   committing   of   the   offence,   by   selling<\/p>\n<p>spurious gold to the complainant.<\/p>\n<p>      3.    The learned counsel for the petitioners submits<\/p>\n<p>that   except   the   confession   statement   of   the   second<\/p>\n<p>B.A.6324\/2006<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>accused,   there   is   no   material   against   the   petitioners.<\/p>\n<p>Accused 5 and 6 are the drivers of the first accused,  who<\/p>\n<p>were actively involved in committing the offence, submits<\/p>\n<p>the prosecution.\n<\/p>\n<\/p>\n<p>        4.    Considering   the   facts   that   are   placed   before<\/p>\n<p>me,   I   direct   the   petitioners,   accused   1,   5   and   6,   to<\/p>\n<p>surrender   before   the   Investigating     Officer,   who   is<\/p>\n<p>investigating   crime   No.   570\/2006   of   Manjeri   Police<\/p>\n<p>Station,  on 3.11.2006 between 9.30 a.m and 10.00 a.m.<\/p>\n<p>        5.    The Investigating Officer shall interrogate the<\/p>\n<p>petitioners   and   thereafter,   produce   them   before   the<\/p>\n<p>competent Magistrate Court,  according to the law.<\/p>\n<p>        6.
