Learned AGP Mr NJ Shah waives service of notice<br \/>\nof admission of appeal for the respondents. Since narrow question of<br \/>\nlaw is involved, the matter is taken up for final hearing on the<br \/>\nrequest of the parties.\n<\/p>\n<p>2.\tThe<br \/>\nappellant approached this Court with Special Civil Application<br \/>\nNo.8627 of 2009 to challenge the order dated 24.4.2008 passed by the<br \/>\nDistrict Development Officer, Ahmedabad. The appellant-petitioner was<br \/>\ngranted higher grade pay scale earlier but as it resulted into<br \/>\nfinancial loss, he requested for withdrawal of the same by cancelling<br \/>\nthe option exercised by the appellant-petitioner. The same was<br \/>\nobjected to by L.F. Audit on the ground that withdrawal of option was<br \/>\npermissible only to those employees who had secured  C  grade.<br \/>\nThe appellant-petitioner did not fall in that category and,<br \/>\ntherefore, the said order was passed cancelling the withdrawal of<br \/>\noption and fixing the pay scale de novo as per rules. On fixation of<br \/>\npay-scale, there  is no dispute. The order also required a note to be<br \/>\nmade in the service book of the appellant and recovery of the excess<br \/>\namount paid to the appellant-petitioner.\n<\/p>\n<p>3.\tThe<br \/>\nappellant-petitioner challenged the said order on the ground that no<br \/>\naudience was given to him before passing the order and the learned<br \/>\nSingle Judge relying on the decision of the Apex Court in the case of<br \/>\n<a href=\"\/doc\/173865\/\">M.C. Mehta vs. Union of India, AIR<\/a> 1999 SC 2583 dismissed the<br \/>\npetition observing that the order is not required to be quashed and<br \/>\nset aside in exercise of powers under Article 226 of the Constitution<br \/>\nof India on the ground that the same is in breach of principles of<br \/>\nnatural justice. It is not always necessary for the Court to strike<br \/>\ndown the order merely because the order has been passed  in breach of<br \/>\nnatural justice. No illegality in the order was indicated to the<br \/>\nlearned Single Judge.\n<\/p>\n<p>4.\tEven<br \/>\nin this appeal, the ground for challenge to the order is financial<br \/>\nloss and breach of principles of natural justice, besides delay in<br \/>\npassing of the order.\n<\/p>\n<p>5.\tThere<br \/>\nis no challenge to the order granting benefit of the higher grade pay<br \/>\nscale dated 1.6.1987 to the petitioner. It is also to be noted that<br \/>\nthe order is passed on the basis of objection by Local Fund Office.<br \/>\nIf that is considered, there is no inordinate delay.\n<\/p>\n<p>6.\tWe<br \/>\ndo not find any defect in the order dated 24.4.2008 impugned in the<br \/>\npetition so far as it relates to cancellation of withdrawal of option<br \/>\nexercised by the appellant-petitioner and restoration of his<br \/>\npay-scale. However, the order also speaks of making a note in the<br \/>\nservice book and recovery fo excess amount paid.\n<\/p>\n<p>7.\tIn<br \/>\nour opinion, the order of recovery is not sustainable. Whatever<br \/>\nexcess amount  was paid to the appellant-petitioner was paid to him<br \/>\nnot out of any fraud or deceit on his part. The excess amount was<br \/>\npaid to him through a mistake. In such a situation, such amount<br \/>\ncannot be recovered. Reference can be made to a decision of the Apex<br \/>\nCourt in <a href=\"\/doc\/868885\/\">Babulal Jain vs. State of M.P. &amp; Ors.,<\/a> (2007) 6 SCC 180.<br \/>\nReference can also be had to an unreported decision of this Court in<br \/>\nLetters Patent Appeal No.578 of 2000 in Special Civil Application<br \/>\nNo.2196 of 1999 dated 4.4.2001 where the Court observed that for the<br \/>\nmistake committed by the employer, the employee cannot be penalised.<br \/>\nRecovery of excess payment made to the employee for no fault on his<br \/>\npart would be unjustified. In our view, therefore, this part of the<br \/>\norder impugned in the petition ought to have been  set aside by the<br \/>\nlearned Single Judge.\n<\/p>\n<p>8.\tUnder<br \/>\nthe circumstances, the appeal deserves to be partly allowed and is<br \/>\naccordingly partly allowed. The order dated 10.9.2009 passed in<br \/>\nSpecial Civil Application No.8627 of 2009 is confirmed and the order<br \/>\nof the District Development Officer, Ahmedabad  dated 24.4.2008 is<br \/>\nalso confirmed to the extent that it relates to cancellation of<br \/>\nwithdrawal of option and refixation of pay-scale  of the<br \/>\nappellant-petitioner. The order of D.D.O. directing recovery of<br \/>\nexcess amount  is set aside. The appeal to that extent is allowed. No<br \/>\ncosts.\n<\/p>\n<p>9.\tSince<br \/>\nthe appeal is disposed of, the civil application also stands disposed<br \/>\nof accordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t(A.L.\n<\/p>\n<p>DAVE, J.)\t<\/p>\n<p>\t\t\t\t\t\t\t(BANKIM<br \/>\nN.
