(ORAL)\n<\/pre>\n<p>            The petitioner, herein, is seeking the writ of certiorari quashing<\/p>\n<p>the Agenda Item No.13 (Annexure P-8) and all other consequential<\/p>\n<p>proceedings yet to be taken by the Governing Body of Guru Nanak Khalsa<\/p>\n<p>College, Yamuna Nagar in pursuance to its meeting scheduled to be held<\/p>\n<p>on 13.09.2011.\n<\/p>\n<p>            While praying for the said relief, learned Senior Counsel<\/p>\n<p>contended that the action is being taken against the petitioner on the basis<\/p>\n<p>of two proceedings held by the Enquiry Committee on two dates and a<\/p>\n<p>secret report based on expert opinion of an Advocate\/Handwriting Expert<\/p>\n<p>who was never produced in the Enquiry nor even cross examined. It is<\/p>\n<p>further contended that the petitioner has not even been issued any charge<\/p>\n<p>sheet nor she has been made aware of the specific charge so as to call for<br \/>\n<span class=\"hidden_text\"> C.W.P. No.17014 of 2011                                                2<\/span><\/p>\n<p>her comments\/reply what to talk of holding a regular enquiry and producing<\/p>\n<p>all witnesses\/evidence against her. No reasonable opportunity to lead her<\/p>\n<p>defence evidence has been granted. The said action is in violation of the<\/p>\n<p>specific provisions of Section 7 of the Haryana Affiliated Colleges (Security<\/p>\n<p>of Service) Act, 1979.\n<\/p>\n<p>            Heard.\n<\/p>\n<p>            Section 7 of the Haryana Affiliated Colleges (Security of<\/p>\n<p>Service) Act, 1979 (here-in-after referred to as &#8220;the Act&#8221;) reads as under :-\n<\/p>\n<pre>                     \"7. Procedure to           be observed before\n               dismissal,      removal,   reduction      in    rank   or\n<\/pre>\n<p>               withholding of annual increment of pay with<br \/>\n               cumulative effect.- (1) No employee shall be<br \/>\n               dismissed, removed, reduced in rank or no annual<br \/>\n               increment or increments of pay of any employee<br \/>\n               shall be withheld with cumulative effect except after<br \/>\n               an enquiry in which he has been informed of the<br \/>\n               charge    against   him    and    given   a    reasonable<br \/>\n               opportunity of being heard in respect of those<br \/>\n               charges :\n<\/p>\n<p>                      Provided that this section shall not apply where<br \/>\n               an employee is dismissed, removed, reduced in rank<br \/>\n               or where the annual increment or increments of pay<br \/>\n               of any employee is or are withheld with cumulative<br \/>\n               effect on the ground of conduct which has led to his<br \/>\n               conviction on a criminal charge.\n<\/p>\n<p>                      (2) The penalty of dismissal, removal from<br \/>\n               service, reduction in rank and withholding of annual<br \/>\n               increment or increments of pay with cumulative effect<br \/>\n               shall not be imposed unless the same is approved by<br \/>\n               the Director.\n<\/p>\n<p>            (3)Where after the enquiry is referred to in sub-section<br \/>\n               (1) it is proposed to impose the penalty of dismissal,<br \/>\n               removal from service, reduction in rank or withholding<br \/>\n               of annual increment or increments of pay with<br \/>\n               cumulative effect, the proposal along with the<br \/>\n               relevant record shall be referred to the Director and<br \/>\n<span class=\"hidden_text\"> C.W.P. No.17014 of 2011                                                3<\/span><\/p>\n<p>              the employee concerned shall be informed.<br \/>\n            (4)The employee may, within a period of thirty days of<br \/>\n              the receipt of the intimation referred to in sub-section<br \/>\n              (3), make a representation against the proposed<br \/>\n              penalty to the Director who may, after examining the<br \/>\n              record and giving the parties an opportunity of being<br \/>\n              heard, by an order in writing, approve the proposed<br \/>\n              penalty or reduce it or refuse to approve it, if the<br \/>\n              proposal is found to be mala fide or by way of<br \/>\n              victimisation or not warranted by the facts and<br \/>\n              circumstances of the case.\n<\/p>\n<p>                     7-A. Continuous of suspension beyond six<br \/>\n               months.-(1) In case the Managing Committee of an<br \/>\n               affiliated college considers it expedient to keep an<br \/>\n               employee under suspension beyond the period of six<br \/>\n               months, it shall submit a detailed report to the<br \/>\n               Director at least one month before the expiry of the<br \/>\n               period of six months specifying reasons warranting<br \/>\n               the extension of the suspension period of the<br \/>\n               employee beyond six months.\n<\/p>\n<p>                     (2) After considering the report under sub-<br \/>\n               section (1), the Director shall pass an order whether<br \/>\n               the extension be granted or not. In the event of his<br \/>\n               refusal    to   grant   the   extension,   the   Managing<br \/>\n               Committee shall reinstate the employee within a<br \/>\n               fortnight from the date of receipt of the order, failing<br \/>\n               which the employee concerned shall be deemed to<br \/>\n               have been reinstated on the expiry of the aforesaid<br \/>\n               period.&#8221;\n<\/p>\n<p>            It is evident from the perusal of the sub-section (2) of Section 7<\/p>\n<p>of the Act that the penalty of dismissal, removal from service, reduction in<\/p>\n<p>rank and withholding of annual increment or increments of pay with<\/p>\n<p>cumulative effect can be imposed only after the same is approved by the<\/p>\n<p>Director. Further sub-section (3) of Section 7 of the Act makes it incumbent<\/p>\n<p>upon the Management to send the entire proceedings along with the<\/p>\n<p>relevant record to the Director with further information to the employee. As<br \/>\n<span class=\"hidden_text\"> C.W.P. No.17014 of 2011                                                4<\/span><\/p>\n<p>per sub-section 4 of Section 7 of the Act, the employee shall have an<\/p>\n<p>opportunity to file representation against the proposed penalty to the<\/p>\n<p>Director who after examining the record may or may not approve the<\/p>\n<p>proposed penalty.\n<\/p>\n<p>             It is evident that as of now only an Agenda has been issued to<\/p>\n<p>take disciplinary action against the petitioner. No penalty has been<\/p>\n<p>imposed as yet. It is not evident as to what disciplinary action has been<\/p>\n<p>proposed by the Management. No such proposal has been sent to the<\/p>\n<p>Director. In case, any such proposal of punishment as referred to in<\/p>\n<p>Section 7 of the Act is sent for approval to the Director, the petitioner shall<\/p>\n<p>have a remedy to file his representation before the Director.\n<\/p>\n<p>             In view of the above, the present petition is disposed of as<\/p>\n<p>pre-mature.
