Heard     learned   counsel      for   the<\/p>\n<p>                     petitioner and the State.\n<\/p>\n<p>                             2. Petitioner-plaintiff is aggrieved by<\/p>\n<p>                     the   order   dated   01.08.2003    passed     by<\/p>\n<p>                     Munsif, 1st, Siwan in Title Suit No. 219 of<\/p>\n<p>                     2001, Annexure-1, whereunder court below<\/p>\n<p>                     has refused the prayer of the petitioner to<\/p>\n<p>                     amend the plaint incorporating the incident<\/p>\n<p>                     which took place over the lands-in-question<\/p>\n<p>                     during the pendency of the suit between<\/p>\n<p>                     28.01.2003-30.01.2003       and    the   bamboo<\/p>\n<p>                     clumps, drain was removed therefrom.<\/p>\n<p>                             3. Without interfering with the order<\/p>\n<p>                     impugned, it is directed that the court below<\/p>\n<p>                     should reconsider the submission of the<\/p>\n<p>                     plaintiff to amend the plaint in the light of the<\/p>\n<p>                     provisions contained in proviso to Section 34<br \/>\n<span class=\"hidden_text\">                          -2-<\/span><\/p>\n<p>         of the Specific Relief Act, 1963 on the<\/p>\n<p>         undertaking of the petitioner that he shall<\/p>\n<p>         pay ad valorem court fee. Necessary order on<\/p>\n<p>         such request be passed by the court below<\/p>\n<p>         after hearing the defendants. Suit is of the<\/p>\n<p>         year 2001, in the circumstances, the court<\/p>\n<p>         below should not only reconsider the matter<\/p>\n<p>         within one month from the date of receipt of<\/p>\n<p>         this order but also ensure that in case relief<\/p>\n<p>         of amendment is allowed, the ad valorem<\/p>\n<p>         court fee is paid by the petitioner within<\/p>\n<p>         another one month. In any case the court<\/p>\n<p>         below will proceed with the matter so as to<\/p>\n<p>         conclude the suit within six months by<\/p>\n<p>         delivering judgment in the matter.<\/p>\n<pre>                 4.
