    W.P.(C) No. 13540 of 2006 was disposed of by<\/p>\n
judgment dated 29-8-2006 directing that the monetary<\/p>\n
benefits due to the petitioner under Exts. P4 and P5<\/p>\n
shall  be  worked  out  and  disbursed    as  early as<\/p>\n
possible.  The writ petitioner has    filed Contempt of<\/p>\n
Court Case as C.O.C. No. 851 of 2007 complaining that<\/p>\n
the judgment has not been implemented.<\/p>\n
    2. Meanwhile respondents in the writ petition have<\/p>\n
filed R.P. No. 682\/07 seeking review of the judgment.<\/p>\n
The ground on which review of the judgment is sought is<\/p>\n
mainly relying on Annexures C and D orders produced<\/p>\n
along with the Review Petition.       It is seen from<\/p>\n
Annexure C order dated 16-12-1972 that the entire<\/p>\n
service of the panchayat employees who were absorbed in<\/p>\n
the  Municipal   Common  Service   consequent  on   the<\/p>\n
conversion of Panchayats into Municipalities will be<\/p>\n
reckoned for purpose of fixation of their rank and<\/p>\n
RP No.682 OF 2007 & COC No. 851\/07             2<\/span><\/p>\n
seniority in the equated categories in the Municipal<\/p>\n
Common Service.         Subsequently, by Annexure D order<\/p>\n
dated 24-11-1998 the Government have clarified the term<\/p>\n
‘equated category’ by stating that it will be construed<\/p>\n
as the post having the same scale of pay or in the<\/p>\n
absence of a post having the same scale of pay in the<\/p>\n
Municipal Common Service, the next lower scale of pay.<\/p>\n
      3. The Govt. Pleader would submit that it was<\/p>\n
without taking note of this aspect that the Government<\/p>\n
passed Exts. P4 and P5 order which were ordered to be<\/p>\n
implemented by the learned Single Judge.         It is pointed<\/p>\n
out that the post of Junior Health Inspector Grade I is<\/p>\n
the post which falls under the equated category in<\/p>\n
terms of Annexure C and D orders.           It is pointed out<\/p>\n
that steps have been taken and notices have been issued<\/p>\n
to correct such erroneous orders issued in the past and<\/p>\n
Annexure     A   issued    to    the petitioner  in  the  writ<\/p>\n
petition and Annexure B issued to yet another person<\/p>\n
are referred to in this context.         It is noticed that on<\/p>\n
absorption into the Municipal Common Service initially<\/p>\n
the petitioner was absorbed in the post of Junior<\/p>\n
Health Inspector Grade I.          Now that reference has been<\/p>\n
made to Annexures C and D, fixation initially given is<\/p>\n
RP No.682 OF 2007 & COC No. 851\/07        3<\/span><\/p>\n
correct and therefore the equation granted to the post<\/p>\n
of Health Inspector Grade II with effect from 1-1-1973<\/p>\n
by Exts. P4 and P5 is incorrect.      If that be so, the<\/p>\n
judgment to that extent need to be reviewed.<\/p>\n
      4. In view of this, the judgment of the learned<\/p>\n
Single Judge will stand reviewed and it is directed<\/p>\n
that the petitioner will be absorbed     in  the equated<\/p>\n
category of Junior Health Inspector Grade I with effect<\/p>\n
from his date of absorption in the Municipal Common<\/p>\n
Service and his seniority and rank will be fixed<\/p>\n
reckoning his entire Panchayat service.      Arrears, if<\/p>\n
any, that are due to him in terms of the Government<\/p>\n
Orders will be paid as expeditiously as possible, at<\/p>\n
any rate within a period of 3 months from the date of<\/p>\n
receipt of a copy of this order.\n<\/p>\n
      5. In view of the order now passed in the Review<\/p>\n
Petition, I close the Contempt of Court Case also.<\/p>\n
      Review Petition and the Contempt of Court Case<\/p>\n
will stand disposed of as above.\n<\/p>\n<\/p>\n
