Ojha, the respondents.\n                             ....\n\n     BY THE COURT:<\/pre>\n<p>           Nobody is present for the appellant though the matter<\/p>\n<p>     has been called out twice over.\n<\/p>\n<p>           This appeal has been preferred against the judgment<\/p>\n<p>     and decree dated 21.02.2007 as passed by the District Judge,<\/p>\n<p>     Churu in Civil Original Suit No. 5\/2002 whereby the suit filed<\/p>\n<p>     by the plaintiff Aziza Bano (since deceased and represented<\/p>\n<p>     by her legal representatives) was decreed as against the<\/p>\n<p>     appellant-defendant    No.1    and        the   alleged     Will   dated<\/p>\n<p>     07.02.1992 was declared null and void as against the interests<\/p>\n<p>     of the plaintiff and the defendant No.2.\n<\/p>\n<p>           This first appeal was admitted for consideration by the<\/p>\n<p>     Registrar (Administration) on 13.04.2007. After completion of<\/p>\n<p>     service, when the matter was taken up on 07.05.2008, learned<\/p>\n<p>     counsel appearing for the respondent submitted that he had<\/p>\n<p>     moved an application for interim relief and, though nobody was<\/p>\n<p>     present for the appellant, the office was directed to list the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>matter for orders on 16.05.2008. The matter was thereafter<\/p>\n<p>taken up on 19.05.2008 while the office reported that no such<\/p>\n<p>application was filed; however, nobody was present for either<\/p>\n<p>of the parties and the matter was adjourned to 22.07.2008.<\/p>\n<p>      On 22.07.2008, learned counsel appearing for the<\/p>\n<p>respondents again submitted that an application for interim<\/p>\n<p>relief was moved after supplying a copy thereof to the learned<\/p>\n<p>counsel for the appellant on 30.07.2007. Again, though<\/p>\n<p>nobody was present for the appellant, but the matter was<\/p>\n<p>ordered to be listed with complete report on 01.08.2008.<\/p>\n<p>      The office again reported that no such application had<\/p>\n<p>been filed but then, nobody was present for either of the<\/p>\n<p>parties on 01.08.2008 and, in the interest of justice, the matter<\/p>\n<p>was adjourned for four weeks. Thereafter, the matter was<\/p>\n<p>taken up only on 06.11.2008 and again nobody was present<\/p>\n<p>for the appellant but, as the learned counsel for the<\/p>\n<p>respondents prayed for time to complete his instructions, the<\/p>\n<p>matter was adjourned for four weeks and in this manner has<\/p>\n<p>come up for consideration today.\n<\/p>\n<p>      It is noticed that in this appeal, consecutively on<\/p>\n<p>07.05.2008,    19.05.2008,    22.07.2008,    01.08.2008,     and<\/p>\n<p>06.11.2008 nobody appeared for the appellant and today<\/p>\n<p>again, nobody is present for the appellant though the matter<\/p>\n<p>has been called out twice over.\n<\/p>\n<p><span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>           Regular default in appearance on behalf of the appellant<\/p>\n<p>     only shows that the appellant has lost interest in prosecuting<\/p>\n<p>     this appeal; and there does not appear any reason to keep this<\/p>\n<p>     appeal pending any further.\n<\/p>\n<p>           The appeal is, therefore, dismissed for want of<\/p>\n<p>     prosecution.\n<\/p>\n<p>                                    (DINESH MAHESHWARI), J.\n<\/p>\n<p>s.soni\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Abdul Kadir vs Lrs.Of Ajij Bano &amp; Ors on 5 December, 2008 1 12 S.B.
