SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/10\/2008 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioner ?  original plaintiff has prayed for an appropriate<br \/>\nWrit, direction or order quashing and setting aside the impugned<br \/>\njudgment and order dated 26.09.2008 passed by the learned Additional<br \/>\nDistrict Judge and Presiding Officer, Fast Track Court No.2, Veraval<br \/>\nin Civil Misc.Appeal No.14 of 2007, in allowing the same by quashing<br \/>\nand setting aside the order passed by the learned Trial Court below<br \/>\nExh.5 in Regular Civil Suit No.94 of 2007.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioner herein ?  original plaintiff had instituted Regular Civil<br \/>\nSuit No.94 of 2007 against the respondents herein restraining them<br \/>\nfrom constructing \/ installing mobile tower sought to be put on the<br \/>\nland owned by respondent No.3 herein. In the said Suit, the<br \/>\npetitioner ?  plaintiff submitted application Exh.5 for interim<br \/>\ninjunction.  It was the contention on behalf of the petitioner ?<br \/>\nplaintiff that the land in question was to be used only for<br \/>\nresidential purpose and mobile tower cannot be constructed on the<br \/>\nsaid land. It was contended on behalf of the petitioner that before<br \/>\nputting up construction, no permission of the Panchayat as<br \/>\ncontemplated under Section 104(1) of the Gujarat Panchayat Act<br \/>\n(herein after referred to as &#8216;the Act&#8217;) has been<br \/>\nobtained.  Learned Principal Senior Civil Judge, Veraval vide<br \/>\norder dated 15.05.2007 allowed application Exh.5 and restrained the<br \/>\nrespondents herein by way of injunction from putting up construction<br \/>\nof mobile tower on the land in question. Being aggrieved and<br \/>\ndissatisfied with the order passed by the learned Trial Court passed<br \/>\nbelow application Exh.5, respondent No.3 herein ?  original<br \/>\ndefendant No.3 preferred Civil Misc.Appeal No.14 of 2007 and the<br \/>\nlearned Additional District Judge and Presiding Officer, Fast Track<br \/>\nCourt No.2, Veraval by impugned judgment and order dated 26.09.2008<br \/>\nallowed the said appeal by quashing and setting aside the order<br \/>\npassed by the learned Trial Court below application Exh.5. Hence, the<br \/>\npetitioner herein ?  plaintiff has preferred present Special Civil<br \/>\nApplication under Article 227 of the Constitution of India.\n<\/p>\n<p>3.\t\tMr.Hriday<br \/>\nBuch, learned Advocate appearing on behalf of the petitioner ?<br \/>\nplaintiff has fairly conceded that in view of the order dated<br \/>\n17.01.2007 passed by the learned Single Judge of this Court in<br \/>\nSpecial Civil Application No.25355 of 2006 the contention on behalf<br \/>\nof the petitioner ?  plaintiff that on residential complex \/ land<br \/>\nmeant for residential purpose, mobile tower cannot be constructed<br \/>\nwill not survive. It is submitted that only ground which is required<br \/>\nto be considered is with respect to permission under Section 104(1)<br \/>\nof the Act. On the other hand, learned Advocates appearing on behalf<br \/>\nof the respondents have submitted that in fact necessary permission<br \/>\nas required has been obtained vide Rajachiti dated 20.04.2006<br \/>\nas well as development permission dated 24.10.2006 produced at Mark<br \/>\n17\/2.  It is also further submitted by the learned Advocates<br \/>\nappearing on behalf of the respondents that initially Sarpanch of the<br \/>\npetitioner ?  Panchayat who is now objecting approached respondent<br \/>\nNos.1 and 2 for construction of mobile tower on his land and as the<br \/>\nsaid deal was not materialized, with a mala-fide intention the<br \/>\nSuit has been filed. It is submitted that considering Rajachiti and<br \/>\ndevelopment permission, permission to put up construction of mobile<br \/>\ntowner is obtained and when the learned Appellate Court has allowed<br \/>\nthe appeal by quashing and setting aside the order passed by the<br \/>\nlearned Trial Court below Exh.5, same may not be interfered with by<br \/>\nthis Court under Article 227 of the Constitution of India.\n<\/p>\n<p>4.\t\tMr.Buch,<br \/>\nlearned Advocate for the petitioner has submitted that so far as<br \/>\nRajachiti and Development permission relied upon by the respondents<br \/>\ndated 20.04.2006 and 24.10.2006 are concerned, same cannot be said to<br \/>\nbe permission granted under Section 104(1) of the Act. It is<br \/>\nsubmitted that under Section 104(1) of the Act, permission is to be<br \/>\nobtained from concerned Panchayat and Rajachiti and Development<br \/>\npermission relied upon by the respondents cannot be said to be by the<br \/>\nPanchayat but the same is by Sarpanch and therefore, it cannot be<br \/>\nsaid that the respondents have obtained permission of Panchayat as<br \/>\ncontemplated under Section 104(1) of the Act.\n<\/p>\n<p>5.\t\tMr.Ashish<br \/>\nDagli, learned Advocate and Mr.Shalin Mehta, learned Advocate for the<br \/>\nrespondents have submitted that until and unless Rajachiti and<br \/>\nDevelopment permission are challenged and\/or quashed and set aside by<br \/>\nthe competent authority, same is in existence and valid and<br \/>\ntherefore, the petitioner unilaterally cannot decide said Rajachiti<br \/>\nand Development permission as illegal. Mr.Buch, learned Advocate for<br \/>\nthe petitioner has submitted that aforesaid Rajachiti and Development<br \/>\npermission are not in accordance with law and same are not required<br \/>\nto be challenged by the petitioner as same can be said to by nullity.\n<\/p>\n<p>6.\t\tHeard<br \/>\nthe learned Advocates appearing on behalf of the respective parties.\n<\/p>\n<p>7.\t\tAs<br \/>\nstated above, only ground which is required to be considered by this<br \/>\nCourt now is whether the respondents have obtained permission for<br \/>\nputting up Mobile tower on the land of respondent No.3 or not. The<br \/>\nrespondents have relied upon Rajachiti and Development permission<br \/>\ndated 20.04.2006 and 24.10.2006 at Mark ?  17\/2 and same is by<br \/>\nSarpach, Gram Panchayat, Lati and same is on the letter pad of Lati<br \/>\nGram Panchayat. It is the contention on behalf of the petitioner<br \/>\nPanchayat now through subsequent Sarpanch that aforesaid Rajachiti<br \/>\nand Development permission cannot be said to in accordance with law<br \/>\nand provision of the Act as same are not by the Panchayat and are by<br \/>\nthe Sarpach of Lati Gram Panchayat is concerned, it is to be noted<br \/>\nthat aforesaid Rajachiti and Development permission are not<br \/>\nchallenged before the competent authority. Unless and until said<br \/>\nRajachiti and Development permission are challenged before the<br \/>\ncompetent authority and are set aside by the competent authority, the<br \/>\npetitioner cannot ignore the said Rajachiti and Development<br \/>\npermission. As on today said Rajachiti and Development permission are<br \/>\nin existence. Under the circumstances, it cannot be said that the<br \/>\nrespondents are putting up mobile tower on the land of respondent<br \/>\nNo.3 without obtaining any permission. The learned Appellate Court<br \/>\nhas rightly allowed the appeal by quashing and setting aside the<br \/>\norder passed by the learned Trial Court below Exh.5 by which the<br \/>\nlearned Trial Court had restrained the respondents herein from<br \/>\nputting up construction of mobile tower. No illegality has been<br \/>\ncommitted by the learned Appellate Court which calls for interference<br \/>\nof this Court in exercise of powers under Article 227 of the<br \/>\nConstitution of India.
