3.   12.08.2011.               Heard learned counsel for the petitioners and<\/p>\n
                    the State.\n<\/p>\n
                               2.   Petitioners   are   presently   serving   as<\/p>\n
                    Revenue Clerk under the Deputy Collector, Revenue<\/p>\n
                    Division, Tarapur, Munger in compliance of the order<\/p>\n
                    of   the   High   Court   dated     25.8.1995   passed    in<\/p>\n
                    C.W.J.C.No. 2296 of 1985 which was heard along with<\/p>\n
                    C.W.J.C.No. 1631 of 1984, whereunder this Court set<\/p>\n
                    aside the termination order passed against the<\/p>\n
                    petitioners of the aforesaid two writ petitions. In<\/p>\n
                    compliance of the aforesaid order dated 25.8.1995<\/p>\n
                    petitioners were reinstated in service under order<\/p>\n
                    bearing Memo No. 101 dated 16.2.1996 issued under<\/p>\n
                    the signature of Deputy Collector, Revenue Division,<\/p>\n
                    Tarapur which is at page-26 of the brief. Present writ<\/p>\n
                    petition has been filed for a direction to the State-<\/p>\n
                    respondents to pay the petitioners arrears of salary for
\n                      2<\/span><\/p>\n
the period during which they remained out of<\/p>\n
employment on account of the termination order<\/p>\n
passed against them by the authorities of the State<\/p>\n
Government. The termination order passed against<\/p>\n
the petitioners and others was the subject matter of<\/p>\n
the aforesaid C.W.J.C.No. 2296 of 1985 which was<\/p>\n
heard along with another C.W.J.C.No. 1631 of 1984<\/p>\n
and this Court under orders dated 25.8.1995 quashed<\/p>\n
the termination order passed against the petitioners of<\/p>\n
C.W.J.C.No. 2296 of 1985 as also against the<\/p>\n
petitioners of C.W.J.C.No. 1631 of 1984. Petitioners of<\/p>\n
C.W.J.C.No. 1631 of 1984 after their reinstatement<\/p>\n
filed yet another writ petition bearing C.W.J.C.No.<\/p>\n
7320 of 1998 praying, inter alia, to direct the State-<\/p>\n
respondents to pay the petitioners of the said writ<\/p>\n
case arrears of salary for the period during which they<\/p>\n
remained out of employment i.e. for the period<\/p>\n
between 16th December, 1982-2nd November, 1986.<\/p>\n
         3. This Court under orders dated 27.10.1999<\/p>\n
passed in C.W.J.C.No. 7320 of 1998, Annexure-3<\/p>\n
directed the State-respondents to make payment to<\/p>\n
the petitioners of C.W.J.C.No. 7320 of 1998 who were<\/p>\n
also petitioners in C.W.J.C.No. 1631 of 1984 the<\/p>\n
arrears of salary for the period between 16.12.1982-<\/p>\n
2.11.1986. Present writ petition has been filed for the<\/p>\n
similar relief which was granted to the petitioners of<\/p>\n
C.W.J.C.No.   1631       of   1984   under   orders   dated
\n                        3<\/span><\/p>\n
27.10.1999 passed in C.W.J.C.No. 7320 of 1998.<\/p>\n
            4.   State-respondents    have   filed    counter<\/p>\n
affidavit    duly    affirmed   by    Executive      Engineer,<\/p>\n
Irrigation Division, Bounsi, Banka stating that as<\/p>\n
there was specific order of this Court in the case of<\/p>\n
petitioners of C.W.J.C.No. 1631 of 1984 vide order<\/p>\n
dated 27.10.1999 passed in C.W.J.C.No. 7320 of<\/p>\n
1998, Annexure-3 to pay arrears of salary for the<\/p>\n
period between 16.12.1982-2.11.1986 during                   the<\/p>\n
period      when    those   petitioners   remained     out    of<\/p>\n
employment petitioners of the said writ case have<\/p>\n
been paid their salary. Similar order having not been<\/p>\n
passed in the case of the petitioners of C.W.J.C.No.<\/p>\n
2296 of 1985 they have not been paid arrears of salary<\/p>\n
for the period between 28.4.1985-16.2.1996 during<\/p>\n
which period the petitioners of the present case who<\/p>\n
were also petitioners in C.W.J.C.No. 2296 of 1985<\/p>\n
were out of employment on account of termination of<\/p>\n
their employment by the authorities of the State.<\/p>\n
            5. Having heard counsel for the parties, I am<\/p>\n
of the view that there is nothing to distinguish the<\/p>\n
case of the petitioners herein who had earlier moved<\/p>\n
the High Court in C.W.J.C.No. 2296 of 1985 from the<\/p>\n
petitioners of C.W.J.C.No. 1631 of 1984 who again<\/p>\n
approached the High Court for payment of arrears of<\/p>\n
salary for the period of their termination which was<\/p>\n
allowed under orders dated 27.10.1999 passed in
\n                             4<\/span><\/p>\n
         C.W.J.C.No. 7320 of 1998. In the circumstances, this<\/p>\n
         writ petition is also disposed of exactly in the same<\/p>\n
         terms which is contained in order dated 27.10.1999<\/p>\n
         passed in C.W.J.C.No. 7320 of 1998, Annexure-3. The<\/p>\n
         Executive Engineer who has sworn the counter<\/p>\n
         affidavit in the matter should ensure payment of the<\/p>\n
         arrears of salary to the petitioners also for the period<\/p>\n
         between 28.4.1985-16.2.1996, as early as possible, in<\/p>\n
         any case within a period of two months from the date<\/p>\n
         of receipt\/production of a copy of this order before the<\/p>\n
