SAINI, ADVOCATE FOR THE RESPONDENT.\n<\/p>\n<p>\nASHUTOSH MOHUNTA, J.(ORAL)<\/p>\n<p>             The Chandigarh Administration has filed this writ petition<\/p>\n<p>impugning the order (Annexure P-3) dated 21.5.2004, passed by the Central<\/p>\n<p>Administrative Tribunal, Chandigarh Bench, vide which they have been<\/p>\n<p>directed to consider the grant of relaxation under Rule 6 of Chandigarh<\/p>\n<p>Education Service (School Cadre) (Group C) Recruitment Rules, 1991 in<\/p>\n<p>regard to respondent&#8217;s qualification as equivalent qualification prescribed<\/p>\n<p>for the post of Nursery Teacher. The petitioners have further been directed<\/p>\n<p>to consider the case of the respondent for regularization of her service also.<\/p>\n<p>             The respondent Sudesh Kumari filed Original Application<\/p>\n<p>before the Tribunal wherein it was prayed that as she possessed the<\/p>\n<p>qualification of Bal Sewika from Indian Council of Child Welfare,<\/p>\n<p>Chandigarh which according to her was equivalent to the qualification for<br \/>\n<span class=\"hidden_text\">                          CWP No.12496-CAT of 2004                        -2-<\/span><\/p>\n<p>Nursery Teacher, therefore, she be considered for appointment as Nursery<\/p>\n<p>Teacher and her services be regularized. It was averred that she has been<\/p>\n<p>working as part time Instructor since December, 1985. It was also averred<\/p>\n<p>that a large number of similarly situated persons who possessed Bal Sewika<\/p>\n<p>Training certificates have been regularized whereas the petitioner has been<\/p>\n<p>ignored.\n<\/p>\n<p>            A perusal of the impugned order shows that services of large<\/p>\n<p>number of persons possessing the Bal Sewika Training certificates have<\/p>\n<p>been regularized as is clear from a perusal of Annexure A-11 dated<\/p>\n<p>16.1.1986. The petitioners have not denied the fact that a large number of<\/p>\n<p>Nursery Teachers possessing similar qualification as that of the petitioner<\/p>\n<p>have been regularized.\n<\/p>\n<p>            Apart from the above, the present respondent had earlier filed<\/p>\n<p>O.A. No.949\/CH\/1992 wherein the Tribunal had directed the Chandigarh<\/p>\n<p>Administration to consider the case of the respondent for appointment as<\/p>\n<p>Nursery Teacher against a vacant post. The respondent was declared<\/p>\n<p>ineligible, therefore, the respondent filed O.A. No.859\/CH\/1998 wherein<\/p>\n<p>directions were given by the Tribunal to consider granting relaxation to the<\/p>\n<p>respondent. Against the order passed in O.A. No.859\/CH\/1998, the<\/p>\n<p>Chandigarh Administration filed writ petition in the High Court bearing<\/p>\n<p>CWP No.9897-CAT of 2002. The operative portion of the order is as<\/p>\n<p>follows:-\n<\/p>\n<blockquote><p>            &#8220;In the result, the writ petition is allowed. The impugned order<\/p>\n<p>            is quashed. However, we deem it proper to direct that the case<\/p>\n<p>            of respondent no.1 be placed before the Administrator, Union<\/p>\n<p>            Territory, Chandigarh for consideration whether it was a fit<br \/>\n<span class=\"hidden_text\">                        CWP No.12496-CAT of 2004                            -3-<\/span><\/p>\n<p>            case for granting relaxation in terms of Rule 6 of the Rules. It<\/p>\n<p>            is hoped that the Administrator would pass appropriate order<\/p>\n<p>            in this respect within 2 months from the receipt of copy of this<\/p>\n<p>            order. If, on a consideration of the entirety of the matter, the<\/p>\n<p>            Administrator comes to the conclusion that the requirement of<\/p>\n<p>            recognition of the certificate by Chandigarh Administration<\/p>\n<p>            should be relaxed, then the candidature of respondent No.1<\/p>\n<p>            shall be considered for regularization and appropriate order<\/p>\n<p>            be passed by the competent authority within next 3 months.&#8221;<\/p><\/blockquote>\n<p>            As the case of the petitioner was not considered in terms of the<\/p>\n<p>order Annexure A-8 passed by the High Court, therefore, the petitioner filed<\/p>\n<p>the O.A. which has been allowed. From the aforementioned facts, it is clear<\/p>\n<p>that the petitioner has been discriminated against as the services of similarly<\/p>\n<p>situated persons who were possessing the certificate of Bal Sewika Training<\/p>\n<p>Course have been regularized, whereas, the petitioner has been ignored.<\/p>\n<p>Moreover the case of the petitioner for relaxation has been considered under<\/p>\n<p>Chandigarh Education Service (School Cadre) (Group &#8216;C&#8217;) Recruitment<\/p>\n<p>(First Amendment) Rules, 2001 whereas, her case should have been<\/p>\n<p>considered in terms of Rule 6 of Chandigarh Education Service (School<\/p>\n<p>Cadre) (Group C) Recruitment Rules.
