Today, learned<br \/>\n\tAdvocate Mr. Soni appearing for respondent NO.3 has placed on record<br \/>\n\taffidavit in reply of respondent no.3. Copy thereof has been served<br \/>\n\tto learned Advocate Mr. Tirmizi for petitioner as well as learned<br \/>\n\tAGP Mr.SHarma for State Authority.\n<\/p>\n<p>In<br \/>\n\tthis petition, petitioner is praying for following reliefs in<br \/>\n\tparagraph 18(A), (B) and (C):\n<\/p>\n<p> 18(A)<br \/>\n\tYOUR LORDSHIP be pleased to issue an appropriate writ, order or<br \/>\n\tdirection quashing and setting aside the order of the competent<br \/>\n\tauthority, Legal Department, Legal Department, Sachivalaya,<br \/>\n\tGandhinagar appointing the respondent NO.4 as Notary in Taluka Sami,<br \/>\n\tDistrict Patan pursuance to the advertisement dated 17.09.2009 and<br \/>\n\tto appoint the petitioner as Notary in Taluka Sami, District Patan<br \/>\n\tin the interest of justice.\n<\/p>\n<p>(B)\tYOUR<br \/>\n\tLORDSHIP be pleased to order pending admission and\/or final disposal<br \/>\n\tof this petition the order of the Competent Authority, Legal<br \/>\n\tDepartment, Legal Department, Sachivalaya, Gandhinagar appointing<br \/>\n\tthe respondent NO.4 as Notary in Taluka Sami, District Patan<br \/>\n\tpursuance to the advertisement dated 17.09.2009 be stayed in the<br \/>\n\tinterest of justice.\n<\/p>\n<p>(C)<br \/>\n\tYOUR LORDSHIP be pleased to grant any other and further relief as<br \/>\n\tmay be deemed fit in the facts and circumstances of the case in the<br \/>\n\tinterest of justice.\n<\/p>\n<p>Thus,<br \/>\n\tpetitioner has made prayer to quash and set aside order passed by<br \/>\n\tcompetent authority in favour of respondent no.3 while appointing<br \/>\n\thim as Notary in Taluka Sami, District Patan pursuant to<br \/>\n\tadvertisement dated 17.9.2009 and to appoint petitioner as notary in<br \/>\n\tTaluka Sami, District Patan in interest of justice.\n<\/p>\n<p>This<br \/>\n\tpetition is directly filed by petitioner before this Court under<br \/>\n\tArticle 226 of Constitution of India challenging appointment of<br \/>\n\trespondent No. 3 as Notary made by State Government. Such direct<br \/>\n\tpetition without prior approach of concerned authority of respondent<br \/>\n\tState is not maintainable as per decision of this Court reported in<br \/>\n\t2007 (1) GLR 314. However, section 10 of The Notaries Act, 1952<br \/>\n\tprovides for removal of names from Register. Section 10 of said Act<br \/>\n\tis, therefore, quoted as under:\n<\/p>\n<p> 10.<br \/>\n\tRemoval of names from Register.-\n<\/p>\n<p>\tThe Government appointing any notary may, by order, remove from the<br \/>\n\tRegister maintained by it under section 4 the name of the notary if<br \/>\n\the &#8211;\n<\/p>\n<p>\t(a) \tmakes a reque4st to<br \/>\n\tthat effect; or <\/p>\n<p>\t(b)\thas not paid any<br \/>\n\tprescribed fee required to be paid by him; or <\/p>\n<p>\t(c)\tis an undischarged<br \/>\n\tinsolvent; or <\/p>\n<p>\t(d)\thas been found, upon<br \/>\n\tinquiry in the prescribed manner, to be guilty of such professional<br \/>\n\tor other misconduct as, in the opinion of the Government, renders<br \/>\n\thim unfit to to practise as Notary; or<\/p>\n<p>\t(e)\tis convicted by any<br \/>\n\tcourt for an offence involving moral turpitude ; or <\/p>\n<p>(f)\tdoes<br \/>\n\tnot get his certificate of practice renewed.\n<\/p>\n<p>\tState<br \/>\n\tGovernment who has appointed respondent No.3 as a Notary has power<br \/>\n\tto consider such representation if it is to be made by any person<br \/>\n\tpointing out that notary who has been appointed is guilty of such<br \/>\n\tprofessional or other misconduct as in the opinion of Government<br \/>\n\trenders him unfit to act as a notary then State Government can<br \/>\n\tcancel appointment of such notary, therefore, for that purpose,<br \/>\n\tpetitioner have  approach first to State Authority.\n<\/p>\n<p>Therefore,<br \/>\n\tlet petitioner may approach respondent authority by way of detailed<br \/>\n\trepresentation within fifteen days from date of receipt of copy of<br \/>\n\tthis order. As and when respondent NO.1 Secretary, Legal Department,<br \/>\n\tSachivalaya, Gandhinagar receives such representation from<br \/>\n\tpetitioner, it is directed to said authority to examine grievance of<br \/>\n\tpetitioner and also consider it which has been made against<br \/>\n\trespondent No.3 and then to pass appropriate reasoned order after<br \/>\n\tgiving reasonable opportunity of hearing to petitioner and<br \/>\n\trespondent No.3 Raval Jagdishkumar Somnath within three months from<br \/>\n\tdate of receiving such representation from petitioner and<br \/>\n\timmediately communicate decision to petitioner as well as respondent<br \/>\n\tNO.3.\n<\/p>\n<p>With<br \/>\n\tthese observations and directions, this petition is disposed of by<br \/>\n\tthis court without expressing any opinion on merits. Notice is<br \/>\n\tdischarged.
