No.378 of 2005\n           ------------------------------------------------\n           Dated this the 4th day of August, 2009\n\n                             ORDER\n<\/pre>\n<p>Pius C. Kuriakose, J<\/p>\n<p>     Having regard to the extensive submissions<\/p>\n<p>which were addressed before us by Sri.S.P.Chaly, the<\/p>\n<p>learned   counsel       for    the     petitioner\/landlord   and<\/p>\n<p>Sri.Sunil Jacob Jose, the learned counsel for the<\/p>\n<p>respondent\/tenant, we are of the view that the<\/p>\n<p>landlord ought to be given an opportunity to amend<\/p>\n<p>his pleadings so that he can offer special reasons<\/p>\n<p>through pleadings for his eligibility to obtain eviction<\/p>\n<p>despite him being possessed of other buildings of his<\/p>\n<p>own. But we are not inclined to grant such opportunity<\/p>\n<p>unconditionally. We are inclined to impose terms. But<\/p>\n<p>at the same time, we also find that the current<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.378 of 2005           -2-<\/span><\/p>\n<p>      monthly rent of Rs.600\/- fixed years ago is far below<\/p>\n<p>      the fair rent which is payable for the building. We are<\/p>\n<p>      inclined to tentatively re-fix the monthly rent payable<\/p>\n<p>      by the respondent\/tenant at Rs.1,000\/- prospectively.<\/p>\n<p>            2. The result of the discussion is as follows:-<\/p>\n<p>            The judgment of the Rent Control Appellate<\/p>\n<p>      Authority and the order of the Rent Control Court are<\/p>\n<p>      set aside. The RCP is remanded to the Rent Control<\/p>\n<p>      Court. That court is directed to allow applications for<\/p>\n<p>      amendment of pleadings to be filed by the landlord.<\/p>\n<p>      Once the pleadings are amended, opportunity will be<\/p>\n<p>      given to the tenant for raising counter pleadings. Once<\/p>\n<p>      the pleadings are completed, one opportunity each will<\/p>\n<p>      be granted by the learned Subordinate Judge for both<\/p>\n<p>      sides for taking pre-trial steps, if any, and thereafter<\/p>\n<p>      the RCP will be posted for trial. Being an old RCP, top<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.378 of 2005           -3-<\/span><\/p>\n<p>      priority will be given to the RCP and revised judgment<\/p>\n<p>      will be passed on the basis of the entire evidence<\/p>\n<p>      which come on record. The above order of remand will<\/p>\n<p>      become operative only subject to the following<\/p>\n<p>      conditions:-\n<\/p>\n<\/p>\n<p>            1) The revision petitioner\/landlord pays a sum of<\/p>\n<p>      Rs.1,500\/- by way of cost to the tenant either directly<\/p>\n<p>      or through his counsel in this Court within ten days<\/p>\n<p>      from today.\n<\/p>\n<\/p>\n<p>            2) The revision petitioner will similarly pay a<\/p>\n<p>      further amount of Rs.1,000\/- to the Kerala Mediation<\/p>\n<p>      Centre within ten days from today and produces<\/p>\n<p>      receipt before this Court.\n<\/p>\n<\/p>\n<p>            The monthly rent payable for the building is<\/p>\n<p>      tentatively re-fixed at Rs.1,000\/- prospectively with<\/p>\n<p>      effect from 1st September, 2009. It is made clear that<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.378 of 2005            -4-<\/span><\/p>\n<p>      our tentative re-fixation of the monthly rent is subject<\/p>\n<p>      to the right of either of parties to move competent<\/p>\n<p>      court for fixation of fair rent.\n<\/p>\n<\/p>\n<p>           3.
