No 82 of 2011<br \/>\n                                 Heard learned counsel for the appellant and<br \/>\n                     learned counsel for State in respect of I.A. No 82 of 2011<br \/>\n                     through which the appellant has renewed his prayer for bail<br \/>\n                     mainly on the ground that another co-accused, Bablu Rai,<br \/>\n                     has been granted bail on 16.12.2010 in Cr. Appeal (D.B.)<br \/>\n                     No. 667 of 2009.\n<\/p>\n<p>                                 Appellant&#8217;s prayer for bail along with other co-<br \/>\n                     accused, Bablu Rai, was earlier rejected on 14.09.2009<br \/>\n                     after noticing the features of the case involving rape and<br \/>\n                     murder of a young girl. No doubt, Bablu Rai has been<br \/>\n                     subsequently granted bail and also another co-accused,<br \/>\n                     Shatrughan Dubey, on the submission that there was no<br \/>\n                     evidence against them except their confessional statement<br \/>\n                     which did not lead to recovery of anything and the<br \/>\n                     confessional statement of this appellant.\n<\/p>\n<p>                                 The submission on behalf of the appellant is<br \/>\n                     that his case stands on the same footing as that of the co-<br \/>\n                     accused, who have been granted bail.\n<\/p>\n<p>                                 However, we find a material difference<br \/>\n                     inasmuch as in the order, dated 14.09.2009, it was noticed<br \/>\n                     that the witnesses found scratch marks on the face of this<br \/>\n                     appellant and he explained to the witnesses while admitting<br \/>\n                     his involvement in the crime that the scratch marks were<br \/>\n                     inflicted by the victim girl. The appellant was sent for<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>       medical examination soon after his arrest and the injury<br \/>\n       report also shows injury in the nature of nail marks on his<br \/>\n       face. That injury report was earlier not available on record,<br \/>\n       but, has now been brought on record pursuant to directions<br \/>\n       in the order, dated 14.09.2009.\n<\/p>\n<p>                   In the aforesaid facts and circumstances we are<br \/>\n       not inclined to grant bail to the appellant on merits. The<br \/>\n       prayer for bail is rejected at this stage.\n<\/p>\n<p>                   Considering the submission that appellant is in<br \/>\n       custody since 15.10.2003, let the hearing of the appeal be<br \/>\n       expedited.
