Reference may be made to the Orders dated 23.3.2009<br \/>\n      and 04.05.2009, which are quoted herein-below;\n<\/p>\n<blockquote><p>             Order dated 23.03.2009:- In course of argument, the learned<br \/>\n             counsel appearing for the appellants, in the light of the<br \/>\n             earlier order passed in this appeal dated 9.2.2009, prays for<br \/>\n             some time so that the appellants will be in a position to<br \/>\n             take a decision. The learned counsel further submitted that<br \/>\n             those respondents, who were not regularized, have now<br \/>\n             produced Class-VIII certificates and decision shall be taken<br \/>\n             at the earliest.\n<\/p><\/blockquote>\n<blockquote><p>                    Hence, we adjourned the hearing of the appeal till 4th<br \/>\n             May, 2009. Within that time, the respondents must take a<br \/>\n             decision and file an affidavit in support thereof.\n<\/p><\/blockquote>\n<blockquote><p>                    Let a copy of this order be given to the learned<br \/>\n             counsel for the respondents.\n<\/p><\/blockquote>\n<blockquote><p>             Order dated 4.5.2009:- Reference may be made to the order<br \/>\n             dated 23.3.2009, in which, the appellants are directed to take<br \/>\n             a decision with regard to regularization of the respondents<br \/>\n             who have produced their necessary educational certificates.\n<\/p><\/blockquote>\n<blockquote><p>                    Learned counsel appearing on behalf of the appellants<br \/>\n             submits that the Principal Secretary, Department of<br \/>\n             Building Construction, who has to take a decision, is out of<br \/>\n             State in Election-Duty as an Observer and a prayer has been<br \/>\n             made for extension of time.\n<\/p><\/blockquote>\n<blockquote><p>                    Prayer is allowed. Time is extended to 27th May, 2009<br \/>\n             to enable the appellants to take a decision.\n<\/p><\/blockquote>\n<blockquote><p>                    Let a copy of this order be given to the learned<br \/>\n             counsel appearing on behalf of the appellants.<\/p><\/blockquote>\n<p>             In view of the aforesaid orders, a supplementary affidavit<br \/>\n      has been filed by the appellant- State on 8.7.2009 wherein, it has<br \/>\n      been stated inter alia that in pursuance of the Orders, a meeting of<br \/>\n<span class=\"hidden_text\">                                      -2-<\/span><br \/>\n        the Establishment Committee was held and some of the<br \/>\n        respondents, who have fulfilled the requirement, have been given<br \/>\n        appointment. However, some of the respondents, i.e. Banwari<br \/>\n        Choudhary (respondent in LPA No. 240\/2003) and Sri Durjan<br \/>\n        Yadav (respondent in LPA No. 242\/2003) have not been considered<br \/>\n        for appointment against Class-IV posts as they failed to produce<br \/>\n        their certificates.\n<\/p>\n<p>               It is further stated that the Committee took a decision to give<br \/>\n        priority to only those daily wage workers whose certificates would<br \/>\n        be found correct after verification done by the concerned Deputy<br \/>\n        Commissioners.\n<\/p>\n<p>               Learned counsel for the respondents very fairly submitted<br \/>\n        that in view of the decision taken by the appellant-State, as stated<br \/>\n        in the supplementary affidavit, there is no need to proceed further<br \/>\n        in this matter.\n<\/p>\n<p>               However, with regard to the direction given by the learned<br \/>\n        Single Judge in the impugned judgment, for payment of wages at a<br \/>\n        minimum pay scale is concerned, it is modified to the extent that<br \/>\n        after regularization of their services, the concerned employees will<br \/>\n        be entitled to get their wages at the particular scale. So long as<br \/>\n        some of the respondents, so continued on daily wages, shall be<br \/>\n        entitled to the wages, as prescribed.\n<\/p>\n<p>               Accordingly, all the Letter Patents Appeals stand disposed<br \/>\n        of with the aforesaid observations and directions.\n<\/p>\n<p>                                                         (M.Y.
