Against the claim of the original plaintiff, the<br \/>\nappellant herein   original defendant filed leave to defend<br \/>\napplication and contended that matter was referred to Arbitrator and<br \/>\nArbitrator has given award and he has made full payment towards the<br \/>\naward. After hearing both the sides, learned Trial Court passed an<br \/>\norder dated 02.04.1999 &#8216;leave to defend is granted subject to<br \/>\ncondition that the defendant should deposit sum of Rs.50,000\/- in the<br \/>\nCourt within six weeks&#8217;. Hence, present appellant   original<br \/>\ndefendant has preferred present Revision Application against the said<br \/>\norder.\n<\/p>\n<p>4.\t\tMr.Chinmay<br \/>\nGandhi, leaned Advocate appearing for the appellant has invited<br \/>\nattention of this Court to Annexure-A,E, and F and has fairly stated<br \/>\nthat unfortunately these documents were not produced before the Trial<br \/>\nCourt in the leave to defend application. This Court has perused<br \/>\nthese documents. On considering these documents, it appears that<br \/>\nprima facie there is some substance.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of above, if impugned order is modified to extent that &#8216;leave to<br \/>\ndefend is granted subject to condition that the appellant herein<br \/>\noriginal defendant should deposit sum of Rs.20,000\/- in the Trial<br \/>\nCourt within a period of 6(six) weeks&#8217;,  the same will meet the ends<br \/>\nof justice.\n<\/p>\n<p>6.\t\tFor<br \/>\nthe reasons stated above, order dated 02.04.1999 passed by the<br \/>\nlearned City Civil Court, Ahmedabad  in Summary Civil Suit No.1576 of<br \/>\n1997 is modified to the extent that &#8216;leave to defend is granted<br \/>\nsubject to condition that the appellant herein   original defendant<br \/>\nshould deposit sum of Rs.20,000\/-  (Rupees Twenty Thousand only) in<br \/>\nthe Trial Court within a period of 6(six) weeks from today&#8217;.
