RADHAKRISHNAN, J.\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n           W.P.(C).No.5220 of 2009-V\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n   Dated this the 18th day of February, 2009.\n\n                   JUDGMENT\n<\/pre>\n<p>Petitioners 2 and 3 are guarantors to the first<\/p>\n<p>petitioner for a transaction under which certain<\/p>\n<p>facilities  were    availed   from   the   fourth<\/p>\n<p>respondent. There were agreements under Section<\/p>\n<p>37 of the KCS Act. The petitioners allege that<\/p>\n<p>respondents 1 to 3 have effected recoveries in<\/p>\n<p>terms of Section 37, however that, the amounts<\/p>\n<p>are not being paid to the fourth respondent and<\/p>\n<p>that this has resulted in the failure to close<\/p>\n<p>the transactions. Under such circumstances, this<\/p>\n<p>Court  has   repeatedly  held   that  the   first<\/p>\n<p>respondent is duty bound to pay to the creditor<\/p>\n<p>society, in this case, the fourth respondent, all<\/p>\n<p>amounts recovered from the debtors and the first<\/p>\n<p>respondent  is  also   to  suffer   the  interest<\/p>\n<p>component adding on to that amount as would be<\/p>\n<p><span class=\"hidden_text\">WP(C)5220\/2009         -: 2 :-<\/span><\/p>\n<p> otherwise payable by the debtors.<\/p>\n<p> For the foregoing reasons, this writ petition is<\/p>\n<p> ordered directing that respondents 1 to 3 will<\/p>\n<p> ensure      that all amounts    recovered from  the<\/p>\n<p> petitioners at the instructions of the fourth<\/p>\n<p> respondent     shall be    released  to  the fourth<\/p>\n<p> respondent with interest that would run on it as<\/p>\n<p> claimed by the fourth respondent in terms of the<\/p>\n<p> contract between the fourth respondent and the<\/p>\n<p> petitioners.     Such amounts    shall  be  released<\/p>\n<p> within a period of one month of the fourth<\/p>\n<p> respondent intimating the second respondent the<\/p>\n<p> amounts so due in terms of this judgment.<\/p>\n<p>                       THOTTATHIL B.
