Considering<br \/>\n\textract of village form no. 7\/12 and extract no. 6 of land in<br \/>\n\tquestion, following are heirs and legal representative of respondent<br \/>\n\tno. 3:\n<\/p>\n<p>(A)<br \/>\n\tMinor Tapan Bipinbhai Ranchhodbhai<\/p>\n<p>(B)<br \/>\n\tHemaben Wd\/o Bipinbhai Ranchhodbhai as herself &amp; as legal<br \/>\n\tguardian of minor, both are residing near Pranami Mandir, Lakhavada,<br \/>\n\tNadiyad.  The death certificate of respondent no. 3 is produced on<br \/>\n\trecord, where date of death is mentioned as 9\/6\/2003.\n<\/p>\n<p>Therefore,<br \/>\n\tconsidering submission made by learned advocate and averment made in<br \/>\n\tthis application supported with affidavit, prayer made in para 5(b)<br \/>\n\tis granted.  Accordingly, cause title of Civil application no.<br \/>\n\t12826\/2009 and Second Appeal (ST) no. 288\/2009 is to be amended<br \/>\n\taccordingly.  In view of this, present application is disposed of.\n<\/p>\n<p>\t ORDER<br \/>\nIN CIVIL APPLICATION NO. 12826\/2009<\/p>\n<p>Heard<br \/>\n\tlearned advocate Mr. AR Patel on behalf of applicant.\n<\/p>\n<p>The<br \/>\n\tpresent application is preferred by applicant original defendant<br \/>\n\twith a prayer to condone delay of two days in filing second appeal.<br \/>\n\tConsidering two days delay, this Court has passed an order without<br \/>\n\tissuing notice to other side.\n<\/p>\n<p>I<br \/>\n\thave considered submission made by learned advocate Mr. Patel and<br \/>\n\tconsidering averment made in this application supported with<br \/>\n\taffidavit, delay of two day is condoned in interest of justice as<br \/>\n\tsufficient cause is shown by applicant to the satisfaction of this<br \/>\n\tCourt.  Accordingly, present application is allowed without issuing<br \/>\n\tnotice to other side for the reason that only two days delay is<br \/>\n\trequired to be condoned except that there is no objection in Second<br \/>\n\tAppeal.\n<\/p>\n<p>Therefore,<br \/>\n\tpresent application is disposed of.
