Act as the petitioner, is in<br \/>\npossession of the property which is fully built up Zieaying<br \/>\nno scope for any further proceedings in the rnatter&#8221;&#8221;.,of<br \/>\nacquisition, etc.   L&#8221; 5 i~<\/p>\n<p>This Writ Petition coming on _for\u00bb..\n<\/p>\n<p>hearing, this day. the Court, passed the foilovvingz V<br \/>\noRDERaT&#8221;l&#8217;eie<\/p>\n<p>In this writ petition, petitioiier is Vseeking ayidirection<\/p>\n<p>to the Bangalore Dey_eloprLien.tianthority &#8216;(therein after<br \/>\nreferred to as SBA for   the schedule<\/p>\n<p>proper;tyas&#8217;  contained in Section 48 of<br \/>\nthe   as the land in question<\/p>\n<p>continues to be&#8217;~in possession of the petitioner and the<\/p>\n<p>is&#8221;ff1iliy_  leaving no scope for any further<\/p>\n<p>rproceedi\u00e9ngs acquisition. A direction is also sought<\/p>\n<p>aga&#8217;jnst..__cthe\u00ab:&#8221;BDA to drop the proposed demolition of the<\/p>\n<p>iresidential buildings, labour quarters and the factory<\/p>\n<p>  &#8216; bniiding built on the schedule property.<\/p>\n<p>Petitioner claims that himself and the members of his<br \/>\nfamily including his brothers have continued to be in<\/p>\n<p>possession and enjoyment of the land Sy.No. 157\/&#8217;5, In<\/p>\n<p>this writ petition, subject matter is <\/p>\n<p>measuring 1 acre 4 guntas, as described .in&#8221;the?Vpetition_._p <\/p>\n<p>with speci\ufb01c boundaries.\n<\/p>\n<p>4. Learned Counsel for 4the&#8221;&#8216;Vpetitioii.er&#8217; <\/p>\n<p>that, as the petitioner has  coliistruvctioin in this<br \/>\nportion and as he is there, and further,<br \/>\nas the BDA hasnot   demolition of<\/p>\n<p>the re:sidentia1&#8243;&#8221;&#8216;ii&#8217;ou&#8217;se&#8217;s&#8217;xand&#8217; the factory will not in any<\/p>\n<p>manner further  of the BDA and that it will only<\/p>\n<p>   upetitio.n_e_r,and his family into deep crisis.<\/p>\n<p> Cionnselplftirther submits that under the provisions of the<\/p>\n<p>  is competent to examine the grievance<\/p>\n<p>&#8216;aupmade the petitioner and to allot such of the portion of<\/p>\n<p>&#8216;~:lf&#8217;thel&#8217;p_roperty where construction is put, in favour of the<\/p>\n<p>  petitioner himself. He draws the attention of the Court to<\/p>\n<p>%E\/<\/p>\n<p>Sec.38~C in this regard. He further contends that since<br \/>\nthe possession is not taken over, the BDA.__ can<\/p>\n<p>recommend the Government for clenotifying the<\/p>\n<p>5. From the petition averments it   <\/p>\n<p>such application is filed by thevpietitiorier-:<\/p>\n<p>the BDA or before the Governrnent. _&#8217;T;h:e&#8221; &#8216;Co'&#8221;t.inse1*i.p<\/p>\n<p>appearing for the BDA,   that<\/p>\n<p>there is no immediate Aithreatnof &#8216;videijn_o&#8217;iition of the existing<br \/>\npremises in the petition&#8221;s_c1ieeia1e&#8217;Vproperty as no such<\/p>\n<p>steps are<br \/>\n   the above, the appropriate<\/p>\n<p>course. for u&#8221;the=petit&#8217;ione1&#8217; is to move the authorities<\/p>\n<p>. it &#8220;&#8221;seeking7&#8217;either denotiiication of the land or for allotment<\/p>\n<p>A of the&#8217;ticvo&#8217;iistrn&#8217;ct.ed portion in accordance with law.<\/p>\n<p>  F\u00e9esewing such Iiberty, this writ petition is<\/p>\n<p> :&#8221;disVpos.e&#8217;d of.
