Tiwari\nRespondent Counsel :- C.S.C.\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p>Dayanand Vidyapeeth Trust Society, through its Vice President<br \/>\nVijay Singh has filed this petition for setting aside the order dated<br \/>\n7th November, 2008 passed by the Deputy Registrar, Firms<br \/>\nSocieties &amp; Chits Kanpur Region Kanpur (hereinafter referred to<br \/>\nas the &#8216;Deputy Registrar&#8217;) as well as the orders dated 7th<br \/>\nDecember, 2009 and 15th December, 2009 passed by the District<br \/>\nInspector of Schools, Kanpur Dehat.\n<\/p>\n<p>It is stated that pursuant to the decision taken by the Regional<br \/>\nLevel Committee on 28\/29th March, 2008, an Authorized<br \/>\nController was appointed to hold fresh elections of the Committee<br \/>\nof Management from amongst the valid members of the General<br \/>\nBody. The Authorized Controller sent a communication to the<br \/>\nDeputy Registrar for providing a valid list of members so that the<br \/>\nelections could be held. The Deputy Registrar, however, by the<br \/>\norder dated 7th November, 2008 registered the list of office<br \/>\nbearers of the Committee of Management of the Society submitted<br \/>\nby respondent No. 5 Committee of Management with its Secretary<br \/>\nRam Nath Singh Sengar.\n<\/p>\n<p>Writ Petition No. 61264 of 2008 was filed by the petitioner to<br \/>\nassail this order. This petition was dismissed by the judgment and<br \/>\norder dated 12th December, 2008 with the following<br \/>\nobservations:-\n<\/p>\n<p>&#8220;Heard learned counsel for the petitioner.\n<\/p>\n<p>The authorised controller is still ceased with the matter of election.<br \/>\nIn the meantime he had asked for list of members from the Asstt.<br \/>\nRegistrar. It is contended by learned counsel for the petitioner that<br \/>\nthe Asstt. Registrar has no jurisdiction to decide about the validity<br \/>\nof the list of members and also decided the validity of the last<br \/>\nelections.\n<\/p>\n<p>Be that as it may, the order of the Asstt. Registrar in pursuance of<br \/>\n the request of the Authorised Controller is just a step in aid in the<br \/>\nelections. The petitioner will get a cause of action to challenge the<br \/>\norder after the elections are held. At that stage he may also<br \/>\nchallenge the order of the Asstt. Registrar. At present it will not be<br \/>\nappropriate for this Court to interfere, when the question of<br \/>\nvalidity of the members, who form the collegium for election is<br \/>\nbeing considered by the authority.\n<\/p>\n<p>The writ petition is premature and dismissed.&#8221;\n<\/p>\n<p>Subsequently elections were held on 7th December, 2009.\n<\/p>\n<p>It is the case of the petitioners that in the elections held on 7th<br \/>\nDecember, 2009, the Committee of Management with Suresh<br \/>\nChandra Gupta as the Manager and Shiv Ram Singh as the<br \/>\nPresident were elected and the papers were submitted to the<br \/>\nDistrict Inspector of Schools on 8th December, 2009 for attesting<br \/>\nof signatures of Suresh Chandra Gupta as the Manager but before<br \/>\nthat, the District Inspector of Schools had attested the signatures of<br \/>\nRam Nath Singh Sengar as Manager on the basis of papers<br \/>\nsubmitted by him with respect of the elections held on the same<br \/>\ndate i.e. 7th December, 2009.\n<\/p>\n<p>The petitioners have, therefore, raised two disputes. The first is<br \/>\nabout the registration of the list of office bearers of the Committee<br \/>\nof Management of the Society on 7th November, 2008 by the<br \/>\nDeputy Registrar. The second dispute is about the recognition of<br \/>\nthe Committee of Management of the Institution which was<br \/>\nelected on 7th December, 2009.\n<\/p>\n<p>It is the contention of the learned counsel for the petitioners that<br \/>\nthe District Inspector of Schools committed an illegality in not<br \/>\napproving the elections of the petitioner-Committee of<br \/>\nManagement by the order dated 15th December, 2009 and the<br \/>\nsignatures of Ram Nath Singh Sengar should not have been<br \/>\nattested on 7th December, 2008. He has further submitted that the<br \/>\nDeputy Registrar also committed an illegality in registering the list<br \/>\nof office bearers submitted by Ram Nath Singh Sengar by the<br \/>\norder dated 7th November, 2008.\n<\/p>\n<p>Sri Ashok Khare, learned Senior Counsel appearing for the<br \/>\nrespondent-Committee of Management submits that so far as the<br \/>\norder passed by the Deputy Registrar is concerned, the petitioners<br \/>\ncan approach the Prescribed Authority under Section 25(1) of the<br \/>\nSocieties Registration Act, 1860 (hereinafter referred to as the<br \/>\n&#8216;Act&#8217;) in accordance with the procedure prescribed therein and with<br \/>\n respect of the second controversy, the petitioners can approach the<br \/>\nRegional Level Committee for determination as to which of the<br \/>\ntwo rival Committee of Managements were validly elected on 7th<br \/>\nDecember, 2009.\n<\/p>\n<p>The Court, therefore, declines to entertain this petition. It shall,<br \/>\nhowever, be open to the petitioners to raise the dispute regarding<br \/>\nthe order dated 7th November, 2008 passed by the Deputy<br \/>\nRegistrar before the Prescribed Authority under Section 25(1) of<br \/>\nthe Act in accordance with the procedure prescribed therein and<br \/>\nwith regard to the validity of the elections of the rival Committee<br \/>\nof Managements held on 7th December, 2009, it shall also be open<br \/>\nto the petitioners to approach the Regional Level Committee. The<br \/>\nCourt has no reason to doubt that the Prescribed Authority shall<br \/>\ndecide the matter expeditiously, after hearing the parties concerned<br \/>\npreferably within a period of four months. The Regional Level<br \/>\nCommittee shall also decide the matter regarding the validity of<br \/>\nthe election held on 7th December, 2009 expeditiously after<br \/>\nhearing the parties concerned, preferably within a period of six<br \/>\nweeks.
