SIRI JAGAN, J.\n               ------------------------------------\n                    O.P.No. 12003 OF 2003\n            ----------------------------------------\n            Dated this the 20th day of February, 2008\n\n                          JUDGMENT\n<\/pre>\n<p>     The petitioner is a retired employee of the University of<\/p>\n<p>Kerala. He has filed this original petition seeking the following<\/p>\n<p>prayers.\n<\/p>\n<blockquote><p>               &#8220;(i)  to issue a writ of mandamus or any<br \/>\n         other appropriate writ order or direction to the<br \/>\n         respondent commanding to reckon the prior service<br \/>\n         of the deceased employee in the Kerala Agricultural<br \/>\n         University from 31.7.1973 to 22.10.1974 too along<br \/>\n         with the service put in by her in the respondent<br \/>\n         University since 23.10.1974 till 25.12.2001 for<br \/>\n         calculation of her net qualifying service and<br \/>\n         accordingly revise the Family Pension and death cum<br \/>\n         retirement gratuity payable and grant the same to<br \/>\n         the petitioner forthwith;\n<\/p><\/blockquote>\n<blockquote><p>               (ii)  to issue a writ of mandamus or any<br \/>\n         other writ order or direction directing the<br \/>\n         respondent to pay interest at the rate of 12% on<br \/>\n         the   arrears   of  family   pension,   death   cum<br \/>\n         retirement gratuity, etc. from 1.3.2002 till the<br \/>\n         date of payment.\n<\/p><\/blockquote>\n<blockquote><p>               (iii) to issue a writ of mandamus or any<br \/>\n         other writ order or direction or directing the<br \/>\n         respondent to pay interest on the amount of<br \/>\n         Provident Fund stood at the credit of the deceased<br \/>\n         employee in her account No.1937 for the November<\/p>\n<p><span class=\"hidden_text\">O.P.No.12003\/03                     2<\/span><\/p>\n<p>            and December 20023 at the same rate of<br \/>\n            interest paid as on 31.10.2002.<\/p><\/blockquote>\n<p>      2.    The learned standing counsel for the University<\/p>\n<p>submits that the prior service in Agricultural University of the<\/p>\n<p>petitioner can be reckoned for the purpose of fixing qualifying<\/p>\n<p>service provided either the petitioner or the Agricultural<\/p>\n<p>University is prepared to pay the proportionate pension<\/p>\n<p>contribution to the Kerala University with compound interest at<\/p>\n<p>the rate of 10%. As far as the alleged delay is concerned, the<\/p>\n<p>University has filed a counter affidavit stating that there is no<\/p>\n<p>delay and therefore there is no question of payment of any<\/p>\n<p>interest.    In the above circumstances, the original petition is<\/p>\n<p>disposed of with the following directions.<\/p>\n<p>      The claim for interest is rejected. As far as the claim of<\/p>\n<p>reckoning of past service in the Kerala Agricultural University<\/p>\n<p>for the purpose of fixing the qualifying service for pension is<\/p>\n<p>concerned, the University shall issue a communication to the<\/p>\n<p>petitioner directing him to see that either the petitioner or the<\/p>\n<p>Agricultural   University    pays     the  proportionate pension<\/p>\n<p>contribution with interest to the Kerala University within a<\/p>\n<p>fixed time.     If the petitioner pays or causes to pay the<\/p>\n<p><span class=\"hidden_text\">O.P.No.12003\/03                  3<\/span><\/p>\n<p>proportionate pension contribution with interest, the University<\/p>\n<p>shall take appropriate steps to recompute the pension and pay<\/p>\n<p>the arrears within a period of three months from the date<\/p>\n<p>when the proportionate pension contribution with interest is<\/p>\n<p>received by the Kerala University.   The communication shall<\/p>\n<p>be issued within a period of one month from the date of receipt<\/p>\n<p>of a copy of this judgment.\n<\/p>\n<\/p>\n<p>                                       S.
