Application No.1473\/1994 in Criminal<br \/>\n\tRevision Application No.377\/1991 came to be filed by legal heirs of<br \/>\n\tdeceased  Odhavji Govindjibhai Mistri, applicant herein to join<br \/>\n\tapplicants of Criminal Misc. Application No.1473\/1994 as<br \/>\n\tapplicants\/petitioners in place of deceased  Odhavji Govindjibhai<br \/>\n\tMistri.\n<\/p>\n<p>This<br \/>\n\tmatter was many time adjourned and in all thirteen times was<br \/>\n\tadjourned. Today even, learned advocate for the applicant in<br \/>\n\tCriminal Misc. Application No.1473\/1994 is not present, while<br \/>\n\tlearned advocate Mr.Ashok Patel for learned advocate Mr.J.D.Ajmera<br \/>\n\tfor the respondents No.1, 2 and 4 is present and learned APP<br \/>\n\tMr.S.S.Patel for the respondent No.5 is present.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Mr.Ashok Patel for the respondents No.1, 2 and 4 places on<br \/>\n\trecord one xerox copy of the compromise pursis entered into between<br \/>\n\tthe parties in one Special Civil Suit No.38\/1994 whereby the<br \/>\n\tapplicants of Criminal Misc. Application No.1473\/1994 and legal<br \/>\n\theirs of original complainant &#8211;  Odhavji Govindjibhai Mistri and<br \/>\n\trespondents of the present Criminal Revision Application reached to<br \/>\n\ta compromise in respect of dispute between them and vide para-6 of<br \/>\n\tthe said compromise pursis, it was agreed between the parties that<br \/>\n\tthe legal heirs of deceased  Odhavji Govindjibhai Mistri shall<br \/>\n\twithdraw the present Criminal Revision Application as well as<br \/>\n\tCriminal Misc. Application No.1473\/1994 filed by the legal heirs of<br \/>\n\tdeceased  Odhavji Govindjibhai Mistri. That compromise is recorded<br \/>\n\tby the concerned Court and directed to draw a decree in terms of the<br \/>\n\tsaid compromise.\n<\/p>\n<p>In<br \/>\n\tabove view of the matter as well as when none appears on behalf of<br \/>\n\tthe applicants in Criminal Misc. Application No.1473\/1994, both<br \/>\n\tthese matters are required to be dismissed.\n<\/p>\n<p>In<br \/>\n\tthe result, the present Criminal Revision Application as well as<br \/>\n\tCriminal Misc. Application No.1473\/1994 both stand dismissed. Rule<br \/>\n\tis discharged. Interim relief, if any, granted by this Court stands<br \/>\n\tvacated.\n<\/p>\n<p>[J.\n<\/p>\n<p>R.
