The Patna Municipal Corporation through the Municipal\n         Commissioner, Bihar, Patna (the successor Organization of PRDA)\n                                           -----------\n<\/pre>\n<p>9.   21.04.2011             No counter affidavit has been filed on behalf of<\/p>\n<p>                  the State of Bihar or the Patna Municipal Corporation.<\/p>\n<p>                            Counsel for the Housing Board submits that<\/p>\n<p>                  under no circumstances can the petitioner be allowed to<\/p>\n<p>                  encroach on any area of the land acquired and handed<\/p>\n<p>                  over to the Housing Board.\n<\/p>\n<p>                            If the contention of the counsel for the Housing<\/p>\n<p>                  Board be accepted the logical conclusion would be that the<\/p>\n<p>                  petitioner is required to be walled up in her house with no<\/p>\n<p>                  means of ingress and egress.\n<\/p>\n<p>                            The order dated 27.1.2011 more than adequately<\/p>\n<p>                  notices that the writ application is raising far more serious<\/p>\n<p>                  issues with regard to Urban Planning of the town of the<\/p>\n<p>                  Patna including laying of residential plots, pathways for<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>ingress and egress etc.<\/p>\n<p>          The writ petition in its present form is raising<\/p>\n<p>more of an administrative issue at this stage with regard to<\/p>\n<p>Urban Planning rather than legal issues. There can be no<\/p>\n<p>two opinions that the petitioner cannot be allowed to<\/p>\n<p>occupy any area settled with the Housing Board.            But<\/p>\n<p>simultaneously, the State Government or the Patna<\/p>\n<p>Municipal Corporation shall have to provide a path way for<\/p>\n<p>ingress and egress to the petitioner from her plot. These<\/p>\n<p>were issues to be more properly considered and kept in<\/p>\n<p>mind as part of larger Urban Planning at the time that the<\/p>\n<p>lands were acquired for the Housing Board.<\/p>\n<p>          The matter is referred to the Secretary, Urban<\/p>\n<p>Department     whom       the   Court   considers    the   most<\/p>\n<p>appropriate authority at this stage of the case to deal with<\/p>\n<p>issues.\n<\/p>\n<p>          The Secretary, Urban Development shall grant a<\/p>\n<p>personal hearing to the petitioner\/her representative, to<\/p>\n<p>the Housing Board, to the Patna Municipal Corporation as<\/p>\n<p>also respondent no. 4\/her representative.           Needless to<\/p>\n<p>stated that the concern of the Court only is that the<\/p>\n<p>petitioner must have an ingress and egress to her<\/p>\n<p>residential plot.\n<\/p>\n<p>          Awaiting the report of the Secretary, Urban<\/p>\n<p>Development, as prayed on behalf of the State of Bihar, list<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>           after six months under the same heading at the same<\/p>\n<p>           position.\n<\/p>\n<p>                       In the meantime, the interim direction contained<\/p>\n<p>           in the order dated 3.3.2011 with regard to the 7 feet 7<\/p>\n<p>           inches passage shall continue to operate.<\/p>\n<pre>P.
