RAMKUMAR, J.\n                     ================\n                      B.A. No.3649 of 2010\n                 ====================\n                Dated: 6th day of August, 2010\n\n                              ORDER\n<\/pre>\n<p>      Petitioners, who are accused Nos.1 to 4 in Crime No.<\/p>\n<p>434\/2010 of Venjaramoodu Police Station for offences punishable<\/p>\n<p>under Sections 323, 294(b), 354 and 427 I.P.C. and 3(I) (X) (XI) of<\/p>\n<p>SC \/ ST (POA) Act, seek anticipatory bail.<\/p>\n<p>      2.    The learned Public Prosecutor opposed the application.<\/p>\n<p>      3.    Anticipatory bail cannot be granted in a case of this<\/p>\n<p>nature. But at the same time, I am inclined to permit the 1st<\/p>\n<p>petitioner to surrender before the Investigating Officer for the<\/p>\n<p>purpose of interrogation and then to have his application for bail<\/p>\n<p>considered by the Magistrate having jurisdiction. Accordingly,<\/p>\n<p>the 1st petitioner shall surrender before the investigating officer<\/p>\n<p>on       18.8.2010 or on 19.8.2010            for the purpose of<\/p>\n<p>interrogation and recovery of incriminating material, if any. The<\/p>\n<p>1st petitioner shall thereafter appear before the Magistrate who<\/p>\n<p>on being satisfied that the 1st petitioner has been interrogated by<\/p>\n<p>the Police, shall   consider and dispose of     his application for<\/p>\n<p>regular bail preferably on the same date on which it is filed.<\/p>\n<p>B.A. No.3649 of 2010<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>      4.     I am inclined to permit Petitioner Nos.2 to 4 to<\/p>\n<p>surrender before the Investigating Officer for the purpose of<\/p>\n<p>interrogation and then to have their application for bail<\/p>\n<p>considered favourably by the Magistrate          having jurisdiction.<\/p>\n<p>Accordingly, Petitioner Nos.2 to 4 shall surrender before the<\/p>\n<p>investigating officer on 18.8.2010 or on 19.8.2010 for the<\/p>\n<p>purpose of interrogation and recovery of incriminating material,<\/p>\n<p>if any. Petitioner Nos.2 to 4 shall thereafter appear before the<\/p>\n<p>Magistrate concerned and file an application for regular bail. On<\/p>\n<p>being convinced that they have been interrogated by the police,<\/p>\n<p>the Magistrate shall release them on        bail on each of them<\/p>\n<p>executing a bond for Rs.25,000\/- (Rupees twenty five thousand<\/p>\n<p>only) with two solvent sureties each for the like amount to the<\/p>\n<p>satisfaction of the Magistrate and subject to the following<\/p>\n<p>conditions:-\n<\/p>\n<blockquote><p>             1.     Petitioner Nos.2 to 4 shall report before the<br \/>\n             Investigating Officer between 9 a.m. and 11 a.m. on<br \/>\n             all Wednesdays.\n<\/p><\/blockquote>\n<blockquote><p>             2.    Petitioner Nos.2 to 4 shall make themselves<br \/>\n             available    for  interrogation including  custodial<br \/>\n             interrogation as and when         required by the<br \/>\n             Investigating Officer.\n<\/p><\/blockquote>\n<blockquote><p>             3.     Petitioner Nos.2 to 4 shall not influence or<br \/>\n             intimidate the prosecution witnesses nor shall they<br \/>\n             attempt to tamper with the evidence for the<br \/>\n             prosecution.\n<\/p><\/blockquote>\n<p>B.A. No.3649 of 2010<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>             4.     Petitioner Nos.2 to 4 shall not commit any<br \/>\n             offence while on bail.\n<\/p>\n<\/p>\n<p>               5.
