{"id":184910,"date":"2010-06-25T00:00:00","date_gmt":"2010-06-24T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/awdesh-and-another-vs-state-of-u-p-on-25-june-2010"},"modified":"2016-06-03T23:18:16","modified_gmt":"2016-06-03T17:48:16","slug":"awdesh-and-another-vs-state-of-u-p-on-25-june-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/awdesh-and-another-vs-state-of-u-p-on-25-june-2010","title":{"rendered":"Awdesh And Another vs State Of U.P. on 25 June, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Awdesh And Another vs State Of U.P. on 25 June, 2010<\/div>\n<pre>                                                                Court No. 20\n\n                    Criminal Appeal No. 1767 of 2010\n\nAwdesh and another                                               Appellants\n                                      Vs\nState of U.P                                                     Opp. Party\n\nHon'ble Raj Mani Chauhan, J.\n<\/pre>\n<p>       Heard learned counsel for the appellants, learned A.G.A. on the point<br \/>\nof admission of criminal appeal and perused the judgment and order dated<br \/>\n11.06.2010.\n<\/p>\n<p>       This appeal has been filed by the accused appellants against the<br \/>\njudgment and order dated 11.06.2010 passed by learned Special Judge,<br \/>\nSC\/ST (PA) Act, Fast Track Court No. 5, Hardoi in Sessions Trial No. 543<br \/>\nof 2000 (Crime No. 106-A of 1999): State Vs Awdesh and others, under<br \/>\nSections 323\/34, 324\/34, 504, 506 I.P.C. and Section 3 (1) 10 SC\/ST Act,<br \/>\nPolice Station Beniganj, District Hardoi, whereby learned Special Judge has<br \/>\nheld the accused guilty under Sections 323\/34, 324\/34, 506 (para II) I.P.C.,<br \/>\nconsequently he has convicted and sentenced each of the accused to<br \/>\nundergo different terms of imprisonment and to pay fine with default<br \/>\nstipulation. The maximum sentence awarded by the trial court is three years<br \/>\nunder Sections 324\/34 and 506 (para-II) I.P.C.\n<\/p>\n<p>       Admit.\n<\/p>\n<p>       Heard learned counsel for the appellants, learned A.G.A on the<br \/>\nprayer for bail of the accused appellants.\n<\/p>\n<p>       Learned counsel for the appellants contends that the maximum<br \/>\nsentence awarded by the trial court is three years under Sections 324\/34 and<br \/>\n506 (para-II) I.P.C. The accused-appellants were on bail during trial and<br \/>\nthey did not misuse the liberty of bail. They are still on interim bail granted<br \/>\nby the trial court to them. Therefore, they deserve to be released on bail.\n<\/p>\n<p>       Learned A.G.A opposed the prayer for bail.\n<\/p>\n<p>       Considered the submissions of the learned counsel for the appellants<br \/>\nand the learned Additional Government Advocate. Keeping in view the<br \/>\nsentence awarded by the trial court to the accused appellants, without<br \/>\nexpressing any opinion on the merits of the appeal, appellants may be<br \/>\nreleased on bail.\n<\/p>\n<p>       Let accused-appellants Awdesh and Sahablal be released on bail in<br \/>\n aforesaid Sessions Trial number during pendency of the appeal on their<br \/>\nfurnishing personal bond with two sureties each in the like amount to the<br \/>\nsatisfaction of the court concerned.\n<\/p>\n<p>         However, the realization of fine is not stayed and the same be<br \/>\ndeposited by the appellant, if not already deposited, within one month from<br \/>\nthe date of their release, failing which this order of bail shall stand<br \/>\ncancelled.\n<\/p>\n<p>25.06.2010<br \/>\nRenu\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Awdesh And Another vs State Of U.P. on 25 June, 2010 Court No. 20 Criminal Appeal No. 1767 of 2010 Awdesh and another Appellants Vs State of U.P Opp. Party Hon&#8217;ble Raj Mani Chauhan, J.
