WRIT PETITION NO.20064 OF 2009\n                         Sri Shivratan Singh &amp; Ors.\n                                     Vs.\n                             State of U.P. &amp; Ors.\nHon'ble Sudhir Agarwal, J.\n<\/pre>\n<p>1.    The only grievance of the petitioners in this writ petition is that they<br \/>\nhave not been paid salary for the period September, 1999 to February,<br \/>\n2000 and from July, 2000 to January, 2001 though they have worked on<br \/>\ntheir respective posts and are entitled for salary. It is further submitted<br \/>\nthat by means of the impugned order, the payment of salary has been<br \/>\ndenied only for the reason that a criminal case being No.3011 of 2000 is<br \/>\npending in the Court of Chief Judicial Magistrate, Farrukhabad and so<br \/>\nlong as this case is pending, no direction can be issued for payment of<br \/>\nsalary.\n<\/p>\n<p>2.    It appears that earlier also this Court in writ petition No.14135 of<br \/>\n2007 filed by these petitioners for payment of salary for the above period<br \/>\npassed an order on 24th September, 2008 to the following effect:\n<\/p>\n<blockquote><p>      &#8220;In view of the above, without going into the merits of the<br \/>\n      case, the writ petition is disposed of with the direction that if<br \/>\n      there is no other legal impediment in paying the salary to the<br \/>\n      petitioners for the aforesaid period, the authorized controller is<br \/>\n      directed to send the salary bills of the petitioners for the<br \/>\n      aforesaid period to the District Inspector of Schools and the<br \/>\n      District Inspector of Schools, after making due verification,<br \/>\n      shall sanction the same in accordance with law. The whole<br \/>\n      exercise will be completed within three months from the date<br \/>\n      a certified copy of this order is produced.&#8221;\n<\/p><\/blockquote>\n<p>3.    Thereafter, the impugned order has been passed by the<br \/>\nconcerned authority again reiterating the same fact about the pendency<br \/>\nof the criminal case though it is not disputed by the learned Standing<br \/>\nCounsel having gone through the entire counter affidavit that no order<br \/>\nhas been passed by this Court or any other Court of law creating any<br \/>\nobstruction for payment of salary for the period in dispute to the<br \/>\npetitioners. Working of the petitioners during the said period is not<br \/>\ndisputed.\n<\/p>\n<p>4.    In the circumstances, I find no reason apparent for denying salary<br \/>\n<span class=\"hidden_text\">                                                                            2<\/span><\/p>\n<p>of the above period to the petitioners. The mere fact that a criminal case<br \/>\nis pending does not entitle the respondents to deny salary to the<br \/>\npetitioners for the period they have actually worked unless the Court<br \/>\npasses an interim order or otherwise entitling the respondents not to<br \/>\nmake payment of salary to the petitioners for certain period as the case<br \/>\nmay be. The reason assigned in the impugned order passed by the<br \/>\nrespondents is clearly flimsy, imaginary and wholly illegal, showing a<br \/>\ntotal non-application of mind on the part of the respondents. It is really<br \/>\nsurprising that an authority like District Inspector of Schools without<br \/>\nunderstanding the things can pass such a flimsy order which has no legal<br \/>\nor otherwise basis. No other reason has been shown to this Court<br \/>\njustifying the act of the respondents for denial of salary to the petitioners<br \/>\nfor the period in dispute.\n<\/p>\n<p>5.    In the circumstances, the writ petition is allowed. The impugned<br \/>\norder dated 24.12.2008, Annexure 10 to the writ petition, is accordingly<br \/>\nset aside. The respondents are directed to pay salary to the petitioner<br \/>\nfrom the period September, 1999 to February, 2000 and from July, 2000<br \/>\nto January, 2001 without any further delay after further verifying the fact<br \/>\nthat the petitioners had discharged duties for the said period, within two<br \/>\nmonths.\n<\/p>\n<p>Dated.27.01.2010<br \/>\nKA\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Shivratnam Singh &amp; Ors vs State Of U.P.
