PATTANAIK (J)\n\nCITATION:\n 1996 AIR 1507\t\t  1996 SCC  (3) 210\n JT 1996 (3)   554\t  1996 SCALE  (3)102\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     Heard the counsel.\n<\/p>\n<p>     This appeal  by special  leave arises from the Order of<br \/>\nthe Punjab  and Haryana\t High Court dated September 13, 1993<br \/>\nmade in\t Writ Petition No.836\/93. The appellant, admittedly,<br \/>\nwas a  sarpanch for  15 years  of the Gram Panchayat village<br \/>\nDialgarh, District  Gurdaspur. It  is her case that the poll<br \/>\nto the office of Sarpanch was to be held on January 18, 1993<br \/>\nand nomination\tpaper was  to be  filed by January 17, 1993.<br \/>\nShe had obtained all the no objection certificates and other<br \/>\ncertificates on\t January 15,  1993. On\tJanuary 17, 1993 she<br \/>\nwent at 12 noon to submit her nomination papers. Her husband<br \/>\nwas wrongfully\tdetained by  the police. It is her case that<br \/>\nthe 7th\t respondent, Tara  Singh had  forcibly snatched\t the<br \/>\nnomination papers  and\ttorn  them  off.  In  spite  of\t her<br \/>\ncomplaint to  the police,  they did  not pay any heed to her<br \/>\nprotest nor  acted on  her complaint.  Consequently, she was<br \/>\nconstrained to\tcomplain at  about 4.30\t p.m.  to  the\tSub-<br \/>\nDivisional Magistrate  present in  the gypsy  vehicle. There<br \/>\nwas an\tentry in  the log book in that behalf. But no action<br \/>\nhad come  through. Since  the election\twas to take place on<br \/>\nJanuary 18,  1993, she\thad approached\tthe High  Court\t and<br \/>\nfiled the  writ petition.  Admittedly, stay was granted at 2<br \/>\np.m. and  it was  communicated telegraphically\tat 3 p.m. on<br \/>\nthe same  day.\tIt  is\talso  seen  that  the  advocate\t had<br \/>\ncommunicated the  same and  it was received at 3.50 p.m. The<br \/>\npoll was  closed at 4.00 p.m. It would thus be seen that the<br \/>\npoll was closed after the stay was granted by the High Court<br \/>\nand having had the knowledge of the stay granted by the High<br \/>\nCourt at 3.00 p.m., the Returning Officer should have stayed<br \/>\nhis hands  back and  awaited the decision of the High Court.<br \/>\nUnfortunately, instead of awaiting the decision, he had gone<br \/>\nin post\t haste in  declaring the 7th respondent to have been<br \/>\nduly elected as a Sarpanch.\n<\/p>\n<p>     Though it\tis denied  that the  appellant had submitted<br \/>\nher nomination papers for contest as a Sarpanch, it would be<br \/>\ndifficult to  believe the  statement of the respondents that<br \/>\nshe had\t not filed  the nomination papers. She had taken all<br \/>\nnecessary steps\t to file  the nomination  papers well within<br \/>\ntime. She  had already\tbeen a\tsitting Sarpanch for over 15<br \/>\nyears. Under  those circumstances,  one\t would\tlegitimately<br \/>\nexpect that  she  have\thad  an\t intention  to\tcontest\t the<br \/>\nelection and  having secured  necessary\t papers,  in  normal<br \/>\ncourse she  would have\tfiled the  nomination papers but for<br \/>\nsome  supervening  event.  It  is  her\tcase  that  the\t 7th<br \/>\nrespondent had forcibly taken the nomination papers from her<br \/>\nand torn them off since her husband was already under police<br \/>\ncustody at the relevant time. She was incapable of resisting<br \/>\nthe high handed action. It is obvious that she was prevented<br \/>\nfrom   filing\t the   nomination    papers.   Under   those<br \/>\ncircumstances,\tshe   was  constrained\t to   approach\t the<br \/>\nauthorities. But  when she  did not get any tangible result,<br \/>\nshe had\t gone to  the High Court and filed the writ petition<br \/>\nmaking\t all\tthe   allegations   therein.   Under   these<br \/>\ncircumstances, we  are\tof  the\t considered  view  that\t the<br \/>\nconduct of  the election  in the circumstances was not valid<br \/>\nin law.\n<\/p>\n<p>     Though the\t learned counsel  for the appellant seeks to<br \/>\nrely upon  Rule 14-A-  of the Punjab Gram Panchayat Election<br \/>\nRules, we  do not  think that  the facts of the case fall in<br \/>\nany of the grounds enumerated in that rule. She can not file<br \/>\nan election  petition equally. However, in view of the facts<br \/>\nstated above,  it being a case of unlawful prevention of the<br \/>\nappellant from\tcontesting the election, the election to the<br \/>\noffice of  Sarpanch held is clearly in violation of the law.<br \/>\nTherefore, the election of the 7th respondent as Sarpanch is<br \/>\nset aside.  He may,  however, continue\ttill the  re-poll is<br \/>\nheld. The  authorities are  directed to conduct the election<br \/>\naccording to  the rules\t within four  weeks from the date of<br \/>\nthe receipt of this order.\n<\/p>\n<p>     The appeal\t is allowed.  Writ is issued accordingly.
