AGP for Respondent: 1, \nNOTICE\nSERVED BY DS for Respondent : 2 -\n4. \n================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/10\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tpetition now is in a narrow compass as it is challenging the<br \/>\n\tstipulation under entry no. 1839 that &#8220;the entry &amp;<br \/>\n\ttransaction is subject to final outcome of SLP that may be filed in<br \/>\n\tthe Supreme Court&#8221;; and also challenges entry no. 1924 dated<br \/>\n\t15\/4\/2011 as it contains stipulation that &#8220;the entry does not<br \/>\n\tconfer any right or title upon the person&#8221;.  These entries are<br \/>\n\tin respect of land bearing survey no. 14\/1, city survey no. 3843 in<br \/>\n\tDwarka Town, district Jamnagar.\n<\/p>\n<p>It<br \/>\n\tis submitted that the Apex Court has disposed of  Special Leave<br \/>\n\tPetition No. 3463 of 2011 at the threshold for which the stipulation<br \/>\n\twas made in entry no. 1839. Hence that stipulation would not now<br \/>\n\trequired to be continued and it is required to be ordered to be<br \/>\n\tdeleted. Orders accordingly, as there exists no justification for<br \/>\n\tthat stipulation to exist on record.\n<\/p>\n<p>So<br \/>\n\tfar as the entry no. 1924 is concerned, said stipulation that &#8220;the<br \/>\n\tentry does not confer any right or title&#8221; is not to be placed<br \/>\n\ton record, as even on earlier occasion also this Court has clearly<br \/>\n\tstipulated that the entry would not confer any right or title in the<br \/>\n\tland in question upon the person in whose favour the entry is made.<br \/>\n\tTherefore this entry no. 1924 being absolutely redundant and exists<br \/>\n\twithout justification on record, same is required to be deleted.<br \/>\n\tHowever deletion of said entry  is once again required to clarified<br \/>\n\tthat this would not confer any right &amp; title by virtue of said<br \/>\n\tentry alone.\n<\/p>\n<p>With<br \/>\n\tthe above observations, the petition is disposed of. Rule made<br \/>\n\tabsolute. No order as to costs.\n<\/p>\n<p>In<br \/>\n\tview of disposal of main matter civil application would not survive<br \/>\n\tand is disposed of.
