 toheutrust. That the defendants have no manner<\/p>\n
ot’rj_ioht,.titie or interest in the trust, They are strangers.<\/p>\n
\\,Their aotwities in misrepresentations they are trustees of<\/p>\n
“t’tis:.e\u00bb_”tA\u00e9f_r:;st has adverseiy affected the trust. The defendants<\/p>\n
  were mduiging in acts to iiquidate the properties of the trust<\/p>\n
 by m\u00e9s representing and hence the Judgment and decree is<\/p>\n

\n thewsuit schedule property and
\nalso for sVVd’irectin.g 1 to 11 to deliver the<\/p>\n
possession of  to the plaintiff ~ trust. At the first<\/p>\n
‘i V’ “v.,loo’i<-it a'ppea_rs thavtmthie suit is brought on behalf of the trust<\/p>\n
 ._.b"ut'. t'iie:"etheirA\u00bb..reji..iefs sought in the piaint makes it clear that<\/p>\n
the.__4"Vttief_ehtiia:i;t No.1 claims to be the sole trustee.<\/p>\n
f_'Undou.btedlvy, A.G.Ramanath ciaims to be the sole trustee.<\/p>\n
it "Xftieiiti–oes' not dispute that the trust is a express religious and<\/p>\n
 Aiheriiitabie trust. The question would be whether the reiiefs<\/p>\n
it sought in the suit fails within the provisions of Section 92<\/p>\n

 Court in the case of BISHWANATH AND<\/p>\n
V –V ANo’*’reE?i\u00a7v\u00a7’sRI THAKUR RADHA BALLABHJI AND OTHERS<\/p>\n
 AIR 1967 SC 1044, wherein it is held as follows:<\/p>\n
H”It is settled law that to invoke $92 of the
\nCode of Civil Procedure, 3 conditions have to
\nbe satisfied, namely, (i) the trust is ereatecl for
\npublic purposes of a charitable or religious<\/p>\n
nature; (ii) there was a breach of trust or a<\/p>\n
purchasers from defendant 1 had aiready
\nacquired possession of the properties soid to
\nthem, a claim for possession of these)”-.<\/p>\n

_A_.N.Via’radaraj-.ului_ Charitable Trust is undoubtedly a<\/p>\n
“iv”~..reli<;}.id'us–t..anid. charitable trust. It came into existence as<\/p>\n
 _irnp.ii"ed:tr:usit'"'a_nd.. thereafter it is now express trust by virtue<\/p>\n
of'  tru_st'i1_. 'Edeed dated 22–O2–1967' registered<\/p>\n
 docurriient No.2797\/196667. Therefore, it is express<\/p>\n
"'–t:*t.ist"i::y virtue of deed of trust and hence its management<\/p>\n
  has to be as per terms and conditions of the said deed. It is<\/p>\n
 also riot in dispute that under the said deed the founder<\/p>\n
15. The present suit is brpught by A.G.Ramanath
\nclaiming himself to be the so\u00e9e trustee of A.N,\\faradarajulu
\nCharitabie Trust; The suit is presented to seek reliefagainst<\/p>\n
defendants for deciaratiori of ownership of”.<\/p>\n
property. The piaint averments and other detaiiisvshioirrlfthlatfll’<\/p>\n
the suit prayer is to seek reCpver\u00a75Vo’f’thes propert_*;_a*i*.’d to<\/p>\n
keep the defendants away from :4the’:gr:ana.:g_erneetiV<\/p>\n
trust on the basis that they ar:e”i.strang–e_rs:.r:”.:Ali”t.:rel’iefs are<\/p>\n
thus in reiation to .h:.anag’enden’t V’otf._’the’Vt’ru’st and its<\/p>\n
properties.\n<\/p>\n

\nschedple  defendants 1 to 11 to
\ndeiiver possesslion:ioifpltthletp\u00e9roiperty to the trust. As could be<\/p>\n
seengfroim Clanus.e:V(r:) pf Section 92 CPC the relief is virtually<\/p>\n
 :fve_st\u00bbi.ng_:’a..n_y property in a trust. Therefore, though by<\/p>\n
ifdifferen’tiaph__ral\u00a7s’eoiogy it is used in the plaint but ‘declaration<\/p>\n
is us’oug;;Vh.t”t.o declare plaintiff trust is the owner of the<\/p>\n
 scn.,e.dul’e property and for direction to defendants 1 to 11 to<\/p>\n

It is further noticed that piaintiff

\nnature and   suit falls under
