Arti Bahuguna vide her RTI application dated 14\/05\/2009 sought<br \/>\ninformation from CPIO, the Oriental Insurance Company Limited, New Delhi regarding the<br \/>\ncircumstances surrounding the charge-sheeting of her husband Shri Vimal Bahuguna in the<br \/>\ncase of vehicle accident claim by Shri Rajendra Singh Topal for vehicle No.UP 06\/3233. She<br \/>\nsought information whether her husband was issued charge-sheet for close proximity or<br \/>\nantedating. She also sought information as to why the hearing of the above mentioned case is<br \/>\nheld during the period when the gates of Badrinath and Kedarnath are opened.\n<\/p>\n<p>2.     The CPIO vide his reply dated 01\/06\/2009 informed that the RTI application have been<br \/>\nreceived on 21\/05\/2009 and that information would be provided to the appellant when it was<br \/>\nreceived from the concerned Department.\n<\/p>\n<p>3.     Not being satisfied by the CPIO&#8217;s order, the appellant preferred first appeal dated<br \/>\n18\/06\/2009 which was not adjudicated upon by the FAA.\n<\/p>\n<p>4.        The appellant has come before the Commission in second appeal.\n<\/p>\n<p>5.     The matter was heard today. Respondents were present. Appellant did not appear.<br \/>\nRespondents in their written submission has stated that CPIO had sent in reply to the appellant<br \/>\non 22\/07\/2009 and FAA had adjudicated on the matter vide his order dated 23\/07\/2009.<br \/>\nCopies of both letters were submitted at the hearing.\n<\/p>\n<p>                                            DECISION\n<\/p>\n<p>6.      It is observed that in CPIO&#8217;s letter dated 22\/07\/2009, information has been provided<br \/>\nthat the charges against Shri Bimal Bahuguna are in respect of antedating.\n<\/p>\n<p>7.     Information sought at point (2) was not clear to the CPIO. The Commission too has<br \/>\nnot understood the nature of the information sought by the appellant through this point.\n<\/p>\n<p>8.        In respect of point (3), information has been denied being third party information.\n<\/p>\n<p>9.     The Commission is not satisfied with the denial of information in respect of point (3)<br \/>\nwherein the appellant had sought to know reasons for fixing hearings by the BO Shri V.K.<br \/>\nGarg and others only at the time of the opening of the gates of Lord Badrinath &amp; Kedarnath.\n<\/p>\n<p><span class=\"hidden_text\">                                                         2<\/span><\/p>\n<p>          10.    Reasons, as available, for fixing the dates of hearing may be provide to the appellant<br \/>\n          within 02 weeks of receipt of this order.\n<\/p>\n<p>          11.    Delay in providing information, which had to be obtained from the other offices, has<br \/>\n          been explained by the respondents, which is accepted.\n<\/p>\n<p>          12.
