DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/10\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\nis successive bail application filed under Section 439 of the Code of<br \/>\nCriminal Procedure in connection with first information report<br \/>\nregistered at CR No.I-20 of 2011 with Kakrapar Police Station, Surat,<br \/>\nfor the offences punishable under Sections 406, 420, 465, 467, 468,<br \/>\n471, 120(B) and 114 of the Indian Penal Code.\n<\/p>\n<p>2.\tLearned<br \/>\ncounsel appearing for the applicants submit that  considering the<br \/>\nnature of evidence, role attributed to the applicants and punishment<br \/>\nprescribed.  It is further submitted that other co-accused are<br \/>\nenlarged on bail and that now charge-sheet is filed, this application<br \/>\nfor bail may kindly be considered.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned APP for the respondent &#8211; State who opposed grant of<br \/>\nbail looking to the nature and gravity of offence.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the accused and punishment prescribed<br \/>\nfor the alleged offences and that other co-accused are enlarged on<br \/>\nbail and applicant No.1 being a female accused and now charge-sheet<br \/>\nis filed, I am inclined to enlarge the applicants on bail.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith first information report registered at CR No.I-20 of 2011 with<br \/>\nKakrapar Police Station, Surat, on executing a bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousand only) each with one surety of the like amount<br \/>\nto the satisfaction of the trial Court and subject to the conditions<br \/>\nthat they shall;\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tmark<br \/>\npresence at the concerned police station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m. till the trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of their residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>7.\tThe<br \/>\nAuthorities will release the applicants only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p>11.\tRule<br \/>\nis made absolute to the aforesaid extent.
