R.P.No.2499 of 2010\n                     -------------------------------\n            Dated this the 19th day of August, 2010.\n\n                          O R D E R\n<\/pre>\n<p>      The accused in a prosecution for an offence u\/s.138 of<\/p>\n<p>Negotiable Instruments Act is the revision petitioner, as he is<\/p>\n<p>aggrieved by the order of conviction and sentence imposed by<\/p>\n<p>the courts below.\n<\/p>\n<p>      2. The case of the complainant is that the accused\/revision<\/p>\n<p>petitioner borrowed a sum of Rs.33,000\/- from the complainant<\/p>\n<p>and towards the discharge of the debt due to the complainant, he<\/p>\n<p>issued a cheque dated 28.2.2004, for a sum of Rs.33,000\/-,<\/p>\n<p>which when presented for encashment dishonoured, as there<\/p>\n<p>was no sufficient fund in the account maintained by the accused<\/p>\n<p>and the cheque amount was not repaid inspite of a formal<\/p>\n<p>demand notice and thus the revision petitioner has committed the<\/p>\n<p>offence punishable u\/s.138 of Negotiable Instruments Act. With<\/p>\n<p>the said allegation, the complainant approached the Judl. First<\/p>\n<p>Class Magistrate Court-II, Kasaragod, by filing a formal<\/p>\n<p>Crl. R.P.No.2499 of 2010<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>complaint, upon which cognizance was taken u\/s.138 of<\/p>\n<p>Negotiable Instruments Act and instituted C.C.No.617\/05.<\/p>\n<p>During the trial of the case, PW1, the complainant himself was<\/p>\n<p>examined from the side of the complainant and Exts.P1 to P6<\/p>\n<p>were marked. No oral or documentary evidence adduced from<\/p>\n<p>the side of the defence. On the basis of the available materials<\/p>\n<p>and evidence on record, the trial court has found that the cheque<\/p>\n<p>in question was issued by the revision petitioner\/accused for the<\/p>\n<p>purpose of discharging his debt due to the complainant. Thus<\/p>\n<p>accordingly the court found that, the complainant has established<\/p>\n<p>the      case        against the accused\/revision   petitioner and<\/p>\n<p>consequently found that the accused is guilty and thus convicted<\/p>\n<p>him u\/s.138 of Negotiable Instruments Act. On such conviction,<\/p>\n<p>the trial court sentenced the revision petitioner to undergo simple<\/p>\n<p>imprisonment for 2 months and to pay a compensation of<\/p>\n<p>Rs.33,000\/- u\/s.357(3) of Cr.P.C. and the default sentence was<\/p>\n<p>fixed as 1 month simple imprisonment.\n<\/p>\n<p>         3.    Though an appeal was filed, at the instance of the<\/p>\n<p>Crl. R.P.No.2499 of 2010<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>revision petitioner\/accused, by judgment dated 19.12.2009 in<\/p>\n<p>Crl.A.148\/06, the Court of Addl. District &amp; Sessions Judge (Ad<\/p>\n<p>hoc-III), Kasaragod, dismissed the appeal, confirming the<\/p>\n<p>conviction and sentence of the revision petitioner u\/s.138 of<\/p>\n<p>Negotiable Instruments Act. It is the above conviction and<\/p>\n<p>sentence challenged in this revision petition.<\/p>\n<p>         4.   I have heard the learned counsel appearing for the<\/p>\n<p>revision petitioner and also perused the judgments of the courts<\/p>\n<p>below.\n<\/p>\n<p>         5.    Reiterating the stand taken by the accused\/revision<\/p>\n<p>petitioner during the trial and appeal, submitted that the<\/p>\n<p>complainant has not established the transaction and also the<\/p>\n<p>execution and issuance of the cheque. But no case is made out<\/p>\n<p>to interfere with the concurrent findings of the trial court as well<\/p>\n<p>as the lower appellate court. Therefore, I find no merit in the<\/p>\n<p>revision petition and accordingly the conviction recorded by the<\/p>\n<p>courts below against the revision petitioner u\/s.138 of Negotiable<\/p>\n<p>Instruments Act, is approved.\n<\/p>\n<p>Crl. R.P.No.2499 of 2010<br \/>\n<span class=\"hidden_text\">                                      4<\/span><\/p>\n<p>         6. As this court is not inclined to interfere with the order of<\/p>\n<p>conviction recorded by the courts below, the counsel for the<\/p>\n<p>revision petitioner submitted that, the sentence of imprisonment<\/p>\n<p>ordered by the courts below is unreasonable and exorbitant and<\/p>\n<p>the same may be set aside and further submitted that, some<\/p>\n<p>breathing time may be granted to deposit the compensation<\/p>\n<p>amount. Having regard to the facts and circumstances involved<\/p>\n<p>in the case, I am of the view that the said submission can be<\/p>\n<p>considered but subject to other relevant facts and circumstances<\/p>\n<p>involved in the case.\n<\/p>\n<p>         7. The apex court in a recent decision reported in <a href=\"\/doc\/1594211\/\">Damodar<\/p>\n<p>S.Prabhu V. Sayed Babalal H. (JT<\/a> 2010(4) SC 457) has held<\/p>\n<p>that, in the case of dishonour of cheques, the compensatory<\/p>\n<p>aspect of the remedy should be given priority over the punitive<\/p>\n<p>aspects. In the present case, the cheque in question is dated<\/p>\n<p>28.2.2004, for an amount of Rs.33,000\/-.             Thus as per the<\/p>\n<p>records and the findings of the courts below, which approved by<\/p>\n<p>this court, a sum of Rs.33,000\/-, which belonged to the<\/p>\n<p>Crl. R.P.No.2499 of 2010<br \/>\n<span class=\"hidden_text\">                                      5<\/span><\/p>\n<p>complainant is with the revision petitioner for the last 6 years.<\/p>\n<p>Therefore, considering the above facts and the settled legal<\/p>\n<p>position, I am of the view that, the sentence of imprisonment<\/p>\n<p>ordered by the courts below, can be modified and at the same<\/p>\n<p>time, the revision petitioner can be granted some time to pay the<\/p>\n<p>compensation amount but subject to slight enhancement with<\/p>\n<p>respect to the compensation amount, considering the fact that<\/p>\n<p>the amount was due from 2004 onwards.\n<\/p>\n<p>         In the result, this revision petition is disposed of confirming<\/p>\n<p>the conviction against the revision petitioner u\/s.138 of<\/p>\n<p>Negotiable Instruments Act as recorded by the courts below.<\/p>\n<p>Accordingly, the sentence of imprisonment ordered by the courts<\/p>\n<p>below is modified and reduced to one day simple imprisonment<\/p>\n<p>ie., till the rising of the court and the revision petitioner is directed<\/p>\n<p>to pay a compensation of Rs.37,000\/- to the complainant u\/s.357<\/p>\n<p>(3) of Cr.P.C., within 3 months from today and in case of default<\/p>\n<p>in paying the compensation amount, the revision petitioner is<\/p>\n<p>directed to undergo simple imprisonment for 3 months.<\/p>\n<p>Crl. R.P.No.2499 of 2010<br \/>\n<span class=\"hidden_text\">                                     6<\/span><\/p>\n<p>Accordingly, the revision petitioner is directed to appear before<\/p>\n<p>the trial court on 16.11.2010, to receive the sentence of<\/p>\n<p>imprisonment and to pay the compensation amount, as fixed by<\/p>\n<p>this court.
