Writ Petition No. 14460 of 2009\n\n\nSomkesh.............................................Petitioner.\n                                  Vs.\nState of U.P. and another..............Respondents.\n\n\nHon'ble Mrs. Poonam Srivastav,J.\n<\/pre>\n<p>        Heard learned counsel for the parties and perused<br \/>\nthe record.\n<\/p>\n<p>        This Criminal Writ Petition has been filed for<br \/>\nquashing the impugned order dated 22.06.2009 passed<br \/>\nby the learned Additional Sessions Judge\/ Special Judge<br \/>\n(SC\/ST) Act, Bulandshahar in Criminal Revision No.202<br \/>\nof 2009, Somkesh Vs. State of U.P. and others as well as<br \/>\norder     dated     03.03.2009        passed       by    the      learned<br \/>\nAdditional      Chief     Judicial      Magistrate,      Court      No.1,<br \/>\nBulandshahar, in Case No.385 of 2007.\n<\/p>\n<p>        The submission of the learned counsel for the<br \/>\npetitioner is that the F.I.R. was registered at Case Crime<br \/>\nNo.422 of 2007, under sections 376 IPC and 3(2)(5)<br \/>\nS.C.\/S.T. Act, P.S.Khurja Nagar, District-Bulandshahar.<br \/>\nThe name of the accused mentioned in FIR was Hirdesh<br \/>\nGupta, S\/O Hoti Lal. Name of the present petitioner was<br \/>\nincluded during the course of investigation. The trial of<br \/>\nthe named accused Hirdesh Gupta was separated and<br \/>\nproceeded as S.T.No.1210 of 2005. The certified copy<br \/>\nof the judgement is annexed as Annexure No.5 to the<br \/>\nwrit petition, dated 5.10.2006, whereby the accused has<br \/>\nbeen acquitted. The submission of the learned counsel<br \/>\nfor the petitioner is that the main accused has already<br \/>\nbeen acquitted and now framing of charge to continue<br \/>\nthe trial against the petitioner is nothing but abuse of<br \/>\n<span class=\"hidden_text\">                                                           2<\/span><\/p>\n<p>the process of the court.\n<\/p>\n<p>     Learned counsel for the petitioner submits that<br \/>\nsince the same evidence and the same allegation is also<br \/>\nin the instant trial, continuance of the trial for a second<br \/>\ntime is liable to be stopped. This fact was brought to<br \/>\nthe notice of the concerned Sessions Judge at the time<br \/>\nof discharge. In the circumstances, rejection of the<br \/>\ndischarge application is liable to be interfered. Reliance<br \/>\nhas been placed of two decisions in the case of Maya<br \/>\nDevi and others Vs. State of U.P., reported in 2006<br \/>\n(56) ACC, page 26 (Hindi) and in the case of<br \/>\nRajendra Kumar Vs. State of U.P. and another,<br \/>\nreported in 2006 (56), page 116.\n<\/p>\n<p>     After hearing learned counsels for respective<br \/>\nparties and going through record, it is clear that<br \/>\npetitioner is not named in the first information report,<br \/>\nno overt role is attributed to him whereas accused who<br \/>\nwas alleged to have eloped with victim and married her,<br \/>\nhas been given a clear verdict of acquittal. According to<br \/>\nprosecution, boy and girl had stayed in the house of<br \/>\npresent petitioner for a single day, therefore, petitioner<br \/>\nhas also been arrayed as an accused.\n<\/p>\n<p>     Taking into consideration principles of stare decisis<br \/>\nlaid down in various decisions, formality of going<br \/>\nthrough a de novo trial in respect of a single accused is<br \/>\nonly wastage of time, energy and money since main<br \/>\naccused has been acquitted. This fact was liable to be<br \/>\ntaken into consideration by the court below and<br \/>\ndischarge application was also liable to be allowed.\n<\/p>\n<p>     For the reasons discussed above, impugned orders<br \/>\ndated   22.6.2009    passed    by   Additional    Sessions<br \/>\nJudge\/Special Judge (SC\/ST) Act, Bulandshahar and<br \/>\n3.3.2009 passed by Additional Chief Judicial Magistrate,<br \/>\n<span class=\"hidden_text\">                                                             3<\/span><\/p>\n<p>court no.1, Bulandshahar are quashed. Proceedings<br \/>\npending    before    the Magistrate    is   set at   naught.<br \/>\nPetitioner will not have to face the trial. He is entitled to<br \/>\nbe given a clear acquittal as that of accused Hirdesh<br \/>\nGupta son of Hoti Lal.
