SHAH\n\t\t\n\t\n\n \n\nDate\n: 20\/09\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioner-Charitable Institution has prayed for an appropriate<br \/>\nwrit, direction and order quashing and setting aside the impugned<br \/>\njudgment award dated 4.7.2001 passed by the Presiding Officer, Labour<br \/>\nCourt, Kalol passed in Reference (LCK) No.82 of 1987 by which the<br \/>\nLabour Court has partly allowed the said reference by directing the<br \/>\npetitioner to reinstate the respondent to her original with 50% back<br \/>\nwages but with continuity of service.\n<\/p>\n<p>2.\tConsidering<br \/>\nthe fact that litigation is pending since 1987 and considering the<br \/>\nfact that even the concerned workman had already reached the age of<br \/>\nsuperannuation (60 years) in the year 2002 and to put an end the<br \/>\nlitigation, there is a broad consensus between the learned advocates<br \/>\nfor the respective parties that instead of reinstatement with 50%<br \/>\nback wages and with continuity of service, respondent be paid<br \/>\nlump-sum monetary compensation of Rs.10,000\/- and it is suggested by<br \/>\nthe learned advocates for the respective parties that aforesaid would<br \/>\nmeet the ends of justice. Learned advocates for the respective<br \/>\nparties have requested to modified the impugned judgment and award<br \/>\npassed by the Labour Court in  Reference (LCK) No.82 of 1987.\n<\/p>\n<p>3.\tIn<br \/>\nview of the broad consensus between the learned advocates for the<br \/>\nrespective parties, petition succeed in part and impugned judgment<br \/>\naward dated 4.7.2001 passed by the Presiding Officer, Labour Court,<br \/>\nKalol passed in Reference (LCK) No.82 of 1987 is hereby quashed and<br \/>\nset aside so far as reinstatement with 50%  back wages and continuity<br \/>\nof service is concerned and is further modified to the extent that<br \/>\nrespondent be paid a total sum of Rs.10,000\/- by way of monetary<br \/>\ncompensation by the petitioner in lieu of reinstatement and back<br \/>\nwages. The aforesaid shall be paid by the petitioner by Account Payee<br \/>\nCheque within a period of six weeks from today. Rule is made absolute<br \/>\nto the aforesaid extent.
