The question of salary then<br \/>\nalso gets under cloud because the employee himself has not followed<br \/>\nthe order of the Tribunal in returning the gratuity and provident<br \/>\nfund. The petitioner has not been paid  pension since 2002.\n<\/p>\n<p>3.\tThe<br \/>\nlearned counsel for the respondent  submits that petitioner did not<br \/>\njoin the duty, he was not paid pension as he remained dismissed<br \/>\nemployee.  This proposition set up by the learned counsel for the<br \/>\nrespondent is under misconception because the respondent knew that<br \/>\nhis reinstatement has been ordered. The question of payment of<br \/>\ngratuity and provident fund was regularly in consideration as he was<br \/>\nin regular touch with the employee. The employee could resume his<br \/>\nduty if asked. No formal proposal from the respondent is coming<br \/>\nforward. Since the petitioner has not worked, for sometime, payment<br \/>\nof salary for that period cannot be countenanced. But,  then this<br \/>\ncannot be lost sight.  But from 2002, the employee was without<br \/>\npension. So delayed payment of pension entails the respondent to pay<br \/>\ninterest on it. The respondent should calculate the amount of pension<br \/>\nfrom the day the petitioner is deemed to have retired at the rate<br \/>\nwhich he was entitled to receive giving notional benefits for the<br \/>\npayment of salary for which he is not said to have worked. Over and<br \/>\nabove the pension, they would pay interest at the  rate of 15% within<br \/>\na period of  six weeks. They would also pay the enhanced amount of<br \/>\ngratuity, which gets enhanced by his extended service.\n<\/p>\n<p>4.\tWith<br \/>\nthe aforesaid observations and directions, the  petition is partly<br \/>\nallowed.  Rule is made absolute to the aforesaid extent.
