Justice P.N.RAVINDRAN\n\n Dated :21\/05\/2009\n\n O R D E R\n                           P.N.RAVINDRAN, J.\n                      -------------------------------------\n                      W.P.(C).No.13672 of 2009\n                     --------------------------------------\n                          Dated 21st May, 2009\n\n                                JUDGMENT\n<\/pre>\n<p>            Heard Sri.T.V.George, the learned counsel appearing for<\/p>\n<p>the petitioners.\n<\/p>\n<p>            2. The petitioners are Live Stock Inspectors appointed<\/p>\n<p>under Rule 9(a)(i) of Part II of the Kerala State &amp; Subordinate Services<\/p>\n<p>Rules. They claim continuance in service till regular hands recruited by<\/p>\n<p>the Kerala Public Service Commission join duty. The issue raised in<\/p>\n<p>this writ petition is directly covered against the petitioners by the<\/p>\n<p>decision of the Full Bench of this Court in <a href=\"\/doc\/802444\/\">Radha v. District Medical<\/p>\n<p>Officer<\/a> (2002 (2) KLT 711). The Full Bench of this Court has in the<\/p>\n<p>aforesaid decision held that employees appointed under Rule 9(a)(i) of<\/p>\n<p>Part II of the Kerala State &amp; Subordinate Services Rules have no right<\/p>\n<p>to continue in service beyond the term for which they were appointed.<\/p>\n<p>Further, the 9th proviso to Rule 9(a)(i) of Part II of the KS &amp; SSR<\/p>\n<p>interdicts such continuance in service. In the light of the authoritative<\/p>\n<p>pronouncement of the Full Bench of this Court and the stipulations in<\/p>\n<p>the 9th proviso to Rule 9(a)(i) of Part II of the KS &amp; SSR, the<\/p>\n<p>petitioners cannot seek or be granted the reliefs prayed for in this writ<\/p>\n<p>petition. Further, the learned Government Pleader appearing for the<\/p>\n<p><span class=\"hidden_text\">WP(C).No.13672\/2009                  2<\/span><\/p>\n<p>respondents submits on instructions that a list of candidates sponsored<\/p>\n<p>by Employment Exchanges has been forwarded to various appointing<\/p>\n<p>authorities as early as on 8.5.2009.          For that reason also the<\/p>\n<p>petitioners cannot seek or be granted the reliefs prayed for in this writ<\/p>\n<p>petition.
