Justice M.L.JOSEPH FRANCIS\n\n Dated :20\/05\/2010\n\n O R D E R\n           K.M.JOSEPH &amp; M.L.JOSEPH FRANCIS, JJ.\n        ------------------------------------------------------\n                  W.P.(C) No.9081 of 2010-I\n            ----------------------------------------------\n             Dated, this the 20th day of May, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>K.M.Joseph, J.\n<\/p>\n<p>              Petitioners have approached this Court seeking<\/p>\n<p>the following relief:&#8211;\n<\/p>\n<blockquote><p>     &#8220;i.   to issue a writ of mandamus or any other<\/p>\n<p>     appropriate    writ,    direction   or    order    directing<\/p>\n<p>     respondents 1 to 3 to afford adequate and effective<\/p>\n<p>     police protection to the life and properties of<\/p>\n<p>     petitioners from being subjected to commission of<\/p>\n<p>     cognizable offences by respondents 4 to 7 and their<\/p>\n<p>     henchmen.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            2.   Briefly put, the case of the petitioners is as<\/p>\n<p>follows: They are residing in old tiled buildings on either side<\/p>\n<p>of a pathway. Ext.P1 is the photograph. Respondents 4 to 7<\/p>\n<p>wanted to convert the pathway to a motorable road by<\/p>\n<p>demolishing the outer walls of residential house. Petitioners<\/p>\n<p>filed suit before the Munsiff Court and obtained injunction<\/p>\n<p>against respondents 4 to 7 from demolishing the outer walls<\/p>\n<p>of residential houses and compound walls. Ext.P2 is the order<\/p>\n<p>of injunction. It is stated that the petitioners are threatened<\/p>\n<p>and intimidated with fear of death to coerce them to withdraw<\/p>\n<p><span class=\"hidden_text\">WPC 9081\/2010                              -2-<\/span><\/p>\n<p>the suit.    In other words, their case is that there is utter<\/p>\n<p>disregard of Ext.P2 order. Petitioners filed Ext.P3 complaint<\/p>\n<p>before the Sub Inspector of Police.<\/p><\/blockquote>\n<p>            3.     We heard the learned counsel for the<\/p>\n<p>petitioners and learned counsel for respondents 4 to 7.<\/p>\n<p>Learned counsel for respondents 4 to 7 would point out that<\/p>\n<p>the 7th respondent was not a party in the suit.         Learned<\/p>\n<p>counsel for the petitioner would submit that the 7th respondent<\/p>\n<p>was included as a person interested in widening the pathway.<\/p>\n<p>The learned counsel for respondents 4 to 7 would submit that<\/p>\n<p>respondents 4 to 7 have no intention to widen the pathway<\/p>\n<p>by demolishing the building.
