NO. 1128 OF 2009\n             = = = = = = = = = = = = = = =\n          Dated this the 2nd day of June, 2009.\n\n                            O R D E R\n<\/pre>\n<p>      This revision is preferred against the order of acquittal<\/p>\n<p>in C.C.149\/05. It was a case moved as a private complaint<\/p>\n<p>which was referred to the police u\/s 156(3) Cr.P.C. and<\/p>\n<p>prosecution was initiated thereafter. The allegations are that<\/p>\n<p>the accused trespassed into the property of CW1 and the 2nd<\/p>\n<p>accused destroyed the rubber, chillu etc. and there was<\/p>\n<p>wrongful confinement by the first accused and also the<\/p>\n<p>allegation of infliction of injuries with a rubber stick. The<\/p>\n<p>independent witnesses to the prosecution are CWs.3 to 6.<\/p>\n<p>The Court gave a large number of opportunities to the<\/p>\n<p>prosecution to produce CWs.3 to 6. There were issuance of<\/p>\n<p>non-bailable warrants and ultimately the Court decided to<\/p>\n<p>close the evidence of the prosecution and arrived at a<\/p>\n<p>decision that the materials are not sufficient to prove the<\/p>\n<p>guilt of the accused.\n<\/p>\n<p>Crl.R.P. 1128 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>      Unlike other cases, this is a case moved as a private<\/p>\n<p>complaint and there was always a responsibility for the<\/p>\n<p>complainant as well to procure the presence of the<\/p>\n<p>witnesses. Keeping silent and quiet at that point of time and<\/p>\n<p>thereafter coming to this Court with a prayer to set aside the<\/p>\n<p>order of acquittal is not proper.     One has to be vigilant.<\/p>\n<p>What prompted the complainant to loose interest in the<\/p>\n<p>prosecution is his own fault and therefore I do not want to<\/p>\n<p>interfere with the order of acquittal passed by the learned<\/p>\n<p>Magistrate. Therefore, this Crl.R.P. is dismissed.<\/p>\n<p>                                 M.N.
