S.J. MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nwrit petition was preferred by the petitioner M\/s. Satin Colours and<br \/>\nCoatings for direction on the respondents to give reconnection of<br \/>\nwater and power supply to plot No.2610 situated within GIDC Estate,<br \/>\nSarigam, District Valsad. According to the petitioner, it owns the<br \/>\nproperty and was  running a unit over there. Now it has given it on<br \/>\nrent to other party.\n<\/p>\n<p>2.\tThe<br \/>\nrespondent-Gujarat Pollution Control Board has stated that the<br \/>\npetitioner has initially given the premises on rent to one M\/s. Bella<br \/>\nBeauty Cosmetics. The said M\/s. Bella Beauty Cosmetics later on<br \/>\nvacated the plot. Subsequently, it has been given on lease in favour<br \/>\nof M\/s. Bioquest International. SVNIT has allowed to give the power<br \/>\nsupply and water supply connection to petitioner&#8217;s plot No.2610.\n<\/p>\n<p>3.\tIn<br \/>\nthe present case, as the electricity company is not a party<br \/>\nrespondent before this Court, it is not clear as to whether any<br \/>\namount is due  to the electricity company from the petitioner or any<br \/>\nearlier unit for giving fresh electrical connection to the present<br \/>\nplot in question. If Gujarat Pollution Control Board has allowed M\/s.<br \/>\nBioquest International to run a unit over there, who is not a party<br \/>\nbefore this Court, and if SVNIT, Surat has given clearance in favour<br \/>\nof said M\/s. Bioquest International and if the said company i.e. M\/s.<br \/>\nBioquest International or the owner of the land i.e. petitioner-<br \/>\nM\/s.Satin Colours and Coatings has applied for electricity supply or<br \/>\nwater supply connection, in that case, such party may move before the<br \/>\nelectricity supply authority or water supply authority to show the<br \/>\npermission granted by the Gujarat Pollution Control Board who may<br \/>\ncertify that the clearance has been given by SVNIT, Surat.
