1.The   petitioner   is   a   Pharmacist   in    an<\/p>\n
 establishment   of   the  third   respondent.   On<\/p>\n
 allegations    of    certain     monetary    loss,<\/p>\n
 ARC.333\/2008   has  been   filed  by   the   third<\/p>\n
 respondent. It being a monetary claim, the first<\/p>\n
 respondent is adjudicating it. The petitioner has<\/p>\n
 filed a written statement raising a counter claim<\/p>\n
 in the said ARC. The petitioner contends that the<\/p>\n
 Managing Director of the third respondent is also<\/p>\n
 an Assistant Registrar and is senior to the first<\/p>\n
 respondent in the service under the Kerala Co-<\/p>\n
 operative Department. His allegation is that the<\/p>\n
 said person is interfering with the proceedings<\/p>\n
 in such a manner that it has become impossible<\/p>\n
 for the petitioner to face the proceedings before<\/p>\n
 the first respondent.\n<\/p>\n

2.On instructions from the second respondent Joint<\/p>\n
 Registrar, the learned Government Pleader states<\/p>\n
 that though the Managing Director of the third<\/p>\n
 respondent is senior to the present incumbent<\/p>\n
 holding office as the first respondent, there is<\/p>\n
 no    legal  ground  for     any  such  apprehension<\/p>\n
 because, it is not possible or permissible for<\/p>\n
 the Managing Director of the third respondent to<\/p>\n
 interfere in the manner in which it is alleged.<\/p>\n
3.The   learned  Government    Pleader is   right in<\/p>\n
 stating that merely on account of departmental<\/p>\n
 seniority     between    different    officers,  if<\/p>\n
 statutory proceedings have to be taken away from<\/p>\n
 the jurisdiction of one officer, it will result<\/p>\n
 in administrative chaos. That is not advisable.<\/p>\n
 At the same time, it also needs to be ensured<\/p>\n
 that a person facing a proceeding in a statutory<\/p>\n
 forum is entitled to the guarantee as to fairness<\/p>\n
 and transparency of the proceedings and also the<\/p>\n
 impartiality of the officer designated to decide.<\/p>\n

 This can be easily ensured in this case, if the<\/p>\n
 Managing Director of the third respondent does<\/p>\n
 not meddle with the proceedings before the first<\/p>\n
 respondent in the ARC in question. The petitioner<\/p>\n
 should have a fair opportunity to cross-examine<\/p>\n
 the witnesses. The first respondent has to ensure<\/p>\n
 that there is no interference from any quarter in<\/p>\n
 that matter and the only regulation can be that<\/p>\n
 which the first respondent would impose as a<\/p>\n
 presiding officer in terms of the law, practice<\/p>\n
 and    procedure.   Unless    the third respondent’s<\/p>\n
 Managing Director is a necessary witness in the<\/p>\n
 proceedings, it is appropriate that he does not<\/p>\n
 participate in the proceeding because, obviously,<\/p>\n
 the case would be presented on behalf of the<\/p>\n
 third      respondent  by     somebody else,   duly<\/p>\n
 authorized.\n<\/p>\n
 For the aforesaid reasons, dispensing with notice<\/p>\n
 to the third respondent and preserving its right<\/p>\n
 to move for review of this judgment if aggrieved,<\/p>\n
 this writ petition is ordered directing that the<\/p>\n
WP(C)34549\/08            -: 4 :-<\/span><\/p>\n
 petitioner will be afforded a fair and complete<\/p>\n
 opportunity to place defence version, evidence<\/p>\n
 and materials, to cross-examine the witnesses and<\/p>\n
 to present the case before the first respondent.<\/p>\n
 The case shall be decided by the first respondent<\/p>\n
 in accordance with law, having regard to the<\/p>\n
 entire      materials  that    would be  placed. The<\/p>\n
 Managing Director of the third respondent will<\/p>\n
 take    note   of   what  is   stated above  and act<\/p>\n
 accordingly.\n<\/p>\n<\/p>\n
