Nigam\nRespondent Counsel :- S.C.\n\nHon'ble Devendra Pratap Singh,J.\n<\/pre>\n<p>Heard learned counsel for the parties.\n<\/p>\n<p>This petition is directed against concurrent orders<br \/>\ndated 18.9.1990 and 2.12.1995 by which objection of<br \/>\nthe petitioner in Misc. Case No. 148 of 1988 has<br \/>\nbeen passed rejecting the recall application.\n<\/p>\n<p>It appears that a Suit No. 231 of 1973 for<br \/>\npossession and injunction was instituted by the<br \/>\ncontesting   respondent   against   the   petitioner&#8217;s<br \/>\npredecessor in interest which was decreed and an<br \/>\nExecution Case No. 3 of 1980 was filed and<br \/>\npossession was delivered to the decree holder on<br \/>\n25.4.1988 and the execution was struck off in<br \/>\nsatisfaction   of   the   decree.   However,   another<br \/>\nExecution Case No. 8 of 1996 was filed for recovery<br \/>\nof cost and during the pendency of the said<br \/>\nexecution    the    petitioner    took    unauthorized<br \/>\npossession of a part of the disputed property and<br \/>\nthus, amendment was also sought which was allowed<br \/>\n(refer to paragraph 2 of the counter affidavit and<br \/>\nits   reply   in   the   rejoinder   affidavit).   The<br \/>\npetitioner filed his objections but the same was<br \/>\ndismissed in default and a restoration application<br \/>\nfiled was also dismissed against which he preferred<br \/>\na revision which has been dismissed and both the<br \/>\norders are under challenge in this petition.\n<\/p>\n<p>This petition was entertained in 1995 and was<br \/>\ndismissed on 22.9.2001. After about two years a<br \/>\nrecall application no. 93795 of 2003 was filed<br \/>\nstating that he came to know that he would be<br \/>\nevicted in pursuance of the decree and only then he<br \/>\ncontacted his counsel when he found about the<br \/>\naforesaid order. The court granted indulgence to the<br \/>\npetitioner and recalled the dismissal order vide its<br \/>\norder dated 3.7.2003 and restored the writ petition.<br \/>\nAgain   this   petition   was  dismissed   for   non<br \/>\nprosecution on 18.9.2007 and again the present<br \/>\nrecall application has been filed after about three<br \/>\nyears on 1.7.2010 repeating the ground that he came<br \/>\nto know through rumours that he would be evicted and<br \/>\n thus, he contacted his counsel.\n<\/p>\n<p>The suit was filed in 1973 and the decree was put in<br \/>\nexecution and possession was delivered but illegally<br \/>\nhe again took possession of a part of the disputed<br \/>\nproperty resulting in a second round of execution<br \/>\nwhere again his objections have been dismissed.<br \/>\nTwice   this  petition   was  dismissed   and  after<br \/>\ninordinate delay he filed restoration application<br \/>\nraising the very same ground in both seeking recall<br \/>\nof the order. If courts start granting indulgence to<br \/>\nsuch recalcitrant litigant, it would be nothing else<br \/>\nbut abuse of the process of court.
