Balachandran, J.\n            --------------------------\n              W.P.(C)No.65 of 2009 G\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Heard counsel for the petitioner. In the nature<\/p>\n<p>of the order that I propose to pass in this writ<\/p>\n<p>petition, it is unnecessary to issue notice to the<\/p>\n<p>respondent.\n<\/p>\n<p>    2.   The suit O.S.No.443\/05 was filed by the<\/p>\n<p>petitioner for a decree of permanent prohibitory<\/p>\n<p>injunction as is submitted before me by the counsel<\/p>\n<p>for the petitioner. Petitioner moved I.A.No.5070\/08<\/p>\n<p>in the said suit under Order XXIII Rule 1(3) CPC to<\/p>\n<p>withdraw the suit with permission to institute a<\/p>\n<p>fresh suit for declaration of title and possession<\/p>\n<p>of  the  petitioner\/plaintiff  over  the  scheduled<\/p>\n<p>property, as according to him, the defects in the<\/p>\n<p>plaint could not be cured by making an amendment<\/p>\n<p>application.  The court below, vide order impugned,<\/p>\n<p>namely Exhibit P3 order dated 11.10.2008, granted<\/p>\n<p>leave to withdraw the suit, but without liberty to<\/p>\n<p>file fresh suit on the same cause of action. It is<\/p>\n<p><span class=\"hidden_text\">WPC 65\/09                2<\/span><\/p>\n<p>aggrieved by the said order that the petitioner\/<\/p>\n<p>plaintiff has preferred this writ petition.<\/p>\n<p>     3.  When a petition is filed seeking for leave<\/p>\n<p>to withdraw the suit with permission to institute a<\/p>\n<p>fresh suit on the same cause of action, it is for<\/p>\n<p>the court to grant permission as prayed for if<\/p>\n<p>grounds exist, to allow such prayer or otherwise to<\/p>\n<p>dismiss the application and not to pass an order<\/p>\n<p>allowing   the   petition   partly   whereby,   the<\/p>\n<p>plaintiff, who withdraws the suit, will be debarred<\/p>\n<p>from filing a fresh suit on the same cause of<\/p>\n<p>action.   In the instant case, the court below has<\/p>\n<p>not granted permission to file fresh suit, but, at<\/p>\n<p>the same time, has allowed the application partly<\/p>\n<p>permitting withdrawal of the suit.    The order is<\/p>\n<p>not legal and is prejudicial to the petitioner\/<\/p>\n<p>plaintiff and requires to be set aside.<\/p>\n<p>     4.
