Raval and<br \/>\n\tlooking to the facts and circumstances of the present case, it<br \/>\n\tappears that:-\n<\/p>\n<p>(i) \tThat, the present<br \/>\napplicant has preferred  Special Civil Application No.20637 of 2007,<br \/>\nwherein ad-interim relief was granted with regard to the salary of<br \/>\nthe applicant. It is directed by this Court that respondents shall<br \/>\nmaintain status quo in respect of the salary of the present<br \/>\napplicant. Said ad-interim relief granted on 23rd August,<br \/>\n2007 was confirmed on 4th March, 2008.\n<\/p>\n<p>(ii)\tIt is stated by the<br \/>\nlearned counsel for the applicant that the basic salary as on 23rd<br \/>\nAugust, 2007 and today is the same at Rs.6,000\/-, but the respondents<br \/>\nhave deducted certain sum of amount from the total salary and,<br \/>\ntherefore, there is contempt committed by the respondents. This<br \/>\ncontention is not accepted by this Court mainly for the reason that<br \/>\nthere is no deduction in the basic salary of the present applicant by<br \/>\nthe respondents and whatever was the basic salary as on date of<br \/>\ngranting of ad-interim relief is continued even as on today. The<br \/>\ndeduction from the salary depends upon the dues of the present<br \/>\napplicant, which can be set off at the time of passing final order in<br \/>\nthe  Special Civil Application No.20637 of 2007. So far as the basic<br \/>\nsalary is concerned, it has been maintained by the respondents.\n<\/p>\n<p>(iii)\tIn<br \/>\nview of the aforesaid, suffice it to say that there is no contempt<br \/>\ncommitted by the respondents of an order passed by this Court much<br \/>\nless a willful disobedience.\n<\/p>\n<p>As<br \/>\n\ta cumulative effect of the aforesaid facts and circumstances of the<br \/>\n\tpresent case, there is no substance in the present application.<br \/>\n\tHence, the present application is dismissed.\n<\/p>\n<pre>\t\t\t\tSd\/-\t\t\t\t\tSd\/-\n \n\n\n(R.P.DHOLAKIA, J.)\n(D.N.
