SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.0.\tPresent<br \/>\nSpecial Criminal Application has been preferred by the petitioner for<br \/>\nthe following relief:\n<\/p>\n<p>17(B).\n<\/p>\n<p>The Hon&#8217;ble Court may be pleased to issue a writ of certiorari or any<br \/>\nother appropriate writ, order or directions for quashing and setting<br \/>\naside the order dated 10.6.2011 passed by the learned Mamlatdar and<br \/>\nExecutive Magistrate, Bharuch by directing the respondent no.1 to<br \/>\nprovide for two rooms and kitchen house as also an amount of<br \/>\nRs.3,00,000\/- (Rupees Three Lacs only) in cash to the petitioner<br \/>\nforthwith as stated by him before the Hon&#8217;ble Court in a proceeding<br \/>\nof Special Criminal Application No.600 of 2011;\n<\/p>\n<p>17(C).\n<\/p>\n<p>Pending admission, hearing and final disposal of this petition, the<br \/>\nHon&#8217;ble Court may be pleased to direct the respondent no.1 to provide<br \/>\nfor two rooms and kitchen house as also an amount of Rs.3,00,000\/-<br \/>\n(Rupees Three Lacs only) in cash to the petitioner forthwith as<br \/>\nstated by him before the Hon&#8217;ble Court in a proceeding of Special<br \/>\nCriminal Application No.600 of 2011;\n<\/p>\n<p>2.0.\tToday,<br \/>\nwhen the present petition is taken up for hearing, Shri Sunil Mehta,<br \/>\nlearned advocate for the petitioner and Shri Mrugen Purohit, learned<br \/>\nadvocate for respondent no.1 have jointly stated at the bar that<br \/>\nparties have settled the dispute amicably and consent terms have been<br \/>\narrived at and entered into between the parties signed by the<br \/>\npetitioner and respondent no.1, by which respondent no.1 has agreed<br \/>\nto provide two Room &amp; Kitchen house situated at Usmanabad<br \/>\nSociety, B\/h. Gujarati School, Rahadpor, Bharuch on ownership basis<br \/>\nto the petitioner and her son namely Ejaj Zakirbhai (Grand son and<br \/>\nrespondent no.1) and same shall be transferred on ownership basis in<br \/>\ntheir favour on or before 30th<br \/>\nSeptember 2011 and vacant and peaceful possession shall be handed<br \/>\nover to petitioner on or before 30th<br \/>\nSeptember 2011. It is further submitted that respondent no.1 has also<br \/>\nagreed to pay a sum of Rs.3 lacs to petitioner towards their welfare<br \/>\nwhich has been paid to her by demand draft. The consent terms dated<br \/>\n4.8.2011 signed by the petitioner as well as respondent no.1 who are<br \/>\npersonally present in the Court, is directed to be taken on record.\n<\/p>\n<p>3.0.\tIn<br \/>\nview of the above consent terms, present Special Criminal Application<br \/>\nis disposed of by directing both the parties, more particularly,<br \/>\nrespondent no.1 to act as stated above and as stated in the consent<br \/>\nterms. Shri Mehta, learned advocate for the petitioner has<br \/>\nassured the Court that amount of Rs.3 lacs (Rupees Three Lacs Only)<br \/>\nwhich is paid to the petitioner, shall be utilized by the petitioner<br \/>\nfor their maintenance and the welfare of her and her son Ejaj and the<br \/>\nsame shall be invested in the Fixed Deposit so that she can get<br \/>\nperiodical interest on the same.
