Shah for petitioner and learned AGP<br \/>\n\tMr. AL Sharma for respondent State Authority.\n<\/p>\n<p>Petitioner<br \/>\n\tis widow of deceased Dayashankar M. Paneri who was appointed with<br \/>\n\teffect from 15.7.1957 as Agricultural Sanyojak, Amreli Sarvodaya<br \/>\n\tYojna, Babapur. Post of Agricultural Sanyojak carried pay scale of<br \/>\n\tRs.170-250 which was thereafter revised upward to Rs.300-560.On<br \/>\n\t1.8.1957, husband of petitioner was appointed as clerk. On 1.4.1959,<br \/>\n\the was appointed as accountant. Said scheme of Sarvodaya Yojna came<br \/>\n\tto be closed as per Resolution dated 31.8.1981. Employees of said<br \/>\n\tSarvodaya Yojna challenged decision of Government before this Court<br \/>\n\twherein it was decided to absorb employees of Scheme in Government<br \/>\n\tPanchayat Services and employees were absorbed as Ex Cadre employees<br \/>\n\tin panchayat service on temporary basis with existing pay scale and<br \/>\n\tallowances which they were drawing when they were working under<br \/>\n\tSarvodaya Youjna without any future benefits like promotion,<br \/>\n\tincrement and other retiral benefits. On 1.4.1987, employees<br \/>\n\tagitated against such conditions imposed by the Government. They<br \/>\n\tmade representation to Government which was considered favourably by<br \/>\n\tGovernment and these employees were treated as fresh recruit as post<br \/>\n\tof Jr. Clerk in Panchayat Service w.e.f. 1.4.1987. His service was<br \/>\n\tcounted only from 1.4.87 even though they had rendered number of<br \/>\n\tyears of service which was not taken into consideration even though<br \/>\n\tthere was no break in service. Husband of petitioner retired on<br \/>\n\t31.1.1997 and on 25.9.1997, husband of petitioner died. According to<br \/>\n\tpetitioner, she is entitled for family pension while considering<br \/>\n\tperiod of services rendered by her husband from the date of joining<br \/>\n\tin the scheme15.7.1957  when her husband was appointed as Agri.<br \/>\n\tSanyojak, Amreli Sarvodaya Yojna Babapur and, therefore, petitioner<br \/>\n\thas filed this petition before this court with a prayer to revise<br \/>\n\tfamily pension.\n<\/p>\n<p>In<br \/>\n\tview of these facts, let petitioner may make detailed representation<br \/>\n\tto respondent authority within one month from date of receipt of<br \/>\n\tcopy of present order. As and when respondent receives such<br \/>\n\trepresentation from petitioner, it is directed to respondent<br \/>\n\tauthority to examine it and consider it and then to pass appropriate<br \/>\n\treasoned order in accordance with law within three months from date<br \/>\n\tof receipt of representation from petitioner and then to communicate<br \/>\n\tdecision to petitioner immediately thereafter.\n<\/p>\n<p>With<br \/>\n\tthese observations and directions, this petition is disposed of by<br \/>\n\tthis court without expressing any opinion on merits.
