Bail Application No.2731\/2009\n\n          {Bhagirath            Ram       Versus    State    of\n          Rajasthan}\n\n          Date of Order ::: 15th July, 2009\n\n                      PRESENT\n     HON'BLE SHRI JUSTICE NARENDRA KUMAR JAIN\n\nShri Farzand Ali, counsel for the petitioner\nShri Ashok Prajapat, PP for the State                                    of\nRajasthan\n                      ####\n\n\nBy the Court:<\/pre>\n<pre>          Heard           learned            counsel        for        the\n\npetitioner(s)            as     well         as     learned       Public\n\nProsecutor      and           perused        the     material          made\n\navailable      to    me       during       the    arguments       of    the\n\ncase.\n\n          It        is    contended          on     behalf    of       the\n\npetitioner that there are cross cases                             in the\n\npresent   case,          wherein          accused    petitioner         has\n\n<\/pre>\n<p>also sustained three injuries; the investigation<\/p>\n<p>is   complete       and       challan       has     been   filed;       the<\/p>\n<p>petitioner was arrested way back on 13th April,<\/p>\n<p>2009 and he is in judicial custody since 1st May,<\/p>\n<p>2009; and the trial of the case is likely to<\/p>\n<p>take time.\n<\/p>\n<p>          After          considering         the     submissions         of<\/p>\n<p>learned counsel for the parties, examining the<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>record and the facts and circumstances of the<\/p>\n<p>case, but without expressing any opinion on its<\/p>\n<p>merits and demerits, I think it fit and proper<\/p>\n<p>to   allow      this    application        under      Section    439,<\/p>\n<p>Cr.P.C.      Hence,      it   is       directed    that   accused-<\/p>\n<p>petitioner Bhagirath Ram S\/o Shri Bhura Ram be<\/p>\n<p>released on bail under Section 439 Cr.P.C. in<\/p>\n<p>F.I.R.
