JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/08\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Articles 226 and 227 of the Constitution of India has<br \/>\nbeen filed, with the following prayers :\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships will be pleased to admit this petition;\n<\/p>\n<p>(B)\tYour<br \/>\nLordships will be pleased to issue a writ of mandamus<br \/>\nor any other appropriate writ, order<br \/>\nand\/or direction expediting the hearing of the Regular Civil Suit<br \/>\nNo.514 of 1993 pending before Ld. Civil Judge (S.D.) Judge, Baroda at<br \/>\nBaroda and be pleased to pass order directing the appeal to be<br \/>\ndecided in the time bound period;\n<\/p>\n<p>(C)\tYour<br \/>\nLordships will be pleased<br \/>\nto grant such other and further relief\/s, as are deemed just, fit,<br \/>\nproper &amp; necessary.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe outset, Mr.Dipak H. Sindhi, learned counsel for the petitioners<br \/>\nsubmits that the interest of justice would be met, if the petitioners<br \/>\nare permitted to make an application to the concerned Court, before<br \/>\nwhich Regular Civil Suit No.514\/1993 is pending and the Trial Court<br \/>\nmay be directed to consider the application for expeditious hearing<br \/>\nof the suit.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned counsel for the<br \/>\npetitioners, the following order is passed :\n<\/p>\n<p>\tThe<br \/>\npetitioners may make an appropriate application before the learned<br \/>\nCivil Judge (Senior Division), Baroda for early hearing of Regular<br \/>\nCivil Suit No.514\/1993.
