Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/05\/2009\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n          W.P.(C).No.12028    OF 2009\n          ===========================\n\n      Dated this the 22nd day of May,2009\n\n                   JUDGMENT\n<\/pre>\n<p>    Petitioners are claiming to be the owners<\/p>\n<p>of building bearing T.C. 28\/627 by name     Ram<\/p>\n<p>Towers       at       Punnapuram,       Pettah,<\/p>\n<p>Thiruvananthapuram and T.C.28\/627(7) rented out<\/p>\n<p>to Sabarinath the main  accused in CBCID Crime<\/p>\n<p>No.169\/CR\/TVPM\/08.   That case was registered<\/p>\n<p>under sections 120B, 406, 409, 420, 202, 212<\/p>\n<p>and 34 IPC.  Consequent to the registration of<\/p>\n<p>the case Dy.SP sealed the building.      Ext.P3<\/p>\n<p>petition    was     submitted    before     the<\/p>\n<p>Superintendent      of      Police,      CBCID,<\/p>\n<p>Thiruvananthapuram to release the building to<\/p>\n<p>the petitioners claiming that they are the<\/p>\n<p>owners of the building.     On the failure to<\/p>\n<p>release the building, this petition is filed<\/p>\n<p>under Article 226 of  Constitution of India for<\/p>\n<p><span class=\"hidden_text\">W.P.(C)12028\/ \/2009            2<\/span><\/p>\n<p>a writ of mandamus or direction to the first<\/p>\n<p>respondent         Superintendent  of   Police,   CBCID,<\/p>\n<p>Thiruvananthapuram to release the vacant premises<\/p>\n<p>to the petitioners and to produce the material<\/p>\n<p>objects kept in the premises before court.<\/p>\n<p>     2.          Learned   counsel  appearing  for   the<\/p>\n<p>petitioners and the learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>     3.        Admittedly the buildings sought to be<\/p>\n<p>released are rented out to Sabarinath the main<\/p>\n<p>accused in CBCID Crime 169\/CR.TVPM\/08.         The fact<\/p>\n<p>that during the investigation of that case the<\/p>\n<p>Investigating Officer         sealed the buildings will<\/p>\n<p>not enable          petitioners, even if they are the<\/p>\n<p>landlords,         to  get  vacant  possession  of   the<\/p>\n<p>buildings.        So  long  as  the  tenancy  continues,<\/p>\n<p>landlord cannot         claim vacant possession of the<\/p>\n<p>building.
