PETITIONERS\n                                              Versus\n                                    THE STATE OF BIHAR\n                                            -----------\n<\/pre>\n<p>2.    28.1.2011                  Supplementary affidavit filed today on behalf<\/p>\n<p>                      of the petitioners be kept on the record.<\/p>\n<p>                                   The petitioners seek quashing of the order<\/p>\n<p>                      dated 29.11.2010 passed by the 1st Additional Sessions<\/p>\n<p>                      Judge, Muzaffarpur in Sessions Trial No.886 of 2008, by<\/p>\n<p>                      which the trial court has rejected an application u\/s.228<\/p>\n<p>                      Cr.P.C.\n<\/p>\n<p>                                   The Counsel for the petitioners submits that<\/p>\n<p>                      initially the case was instituted u\/s.302\/34 I.P.C., but<\/p>\n<p>                      subsequently there were materials during investigation<\/p>\n<p>                      which warranted submission of charge sheet u\/s.306 I.P.C.<\/p>\n<p>                      but the same was not done nor has charge been framed in<\/p>\n<p>                      the said section alternatively.\n<\/p>\n<p>                                   Since it is the demand of the petitioner to<\/p>\n<p>                      frame an alternative charge u\/s.306 I.P.C., I would direct<\/p>\n<p>                      the trial court to consider framing of charge alternatively<\/p>\n<p>                      also u\/s.306 I.P.C. to meet the ends of justice.<\/p>\n<p>                                   With these observations, the application is<\/p>\n<p>                      allowed.\n<\/p>\n<\/p>\n<pre>Narendra\/                                 ( Anjana Prakash, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ram Babu Roy And Anr. vs The State Of Bihar on 28 January, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
